Murder has been around longer than the ballot and is often more influential... Benazir Bhutto's father was prime minister of Pakistan in the 1970s and, before he was hanged, he would tell her to study the lives of great women as inspiration. She sometimes told reporters that story, including the names of Joan of Arc and Indira Gandhi as study subjects suggested by her dad. The French revolutionary was burned at the stake; the Indian prime minister was assassinated by her bodyguards. Their violent ends did not deter Bhutto, nor did the murders of her father and brother. A Harvard graduate with a sharp knowledge of history, she would have known that The Assassination has been around a lot longer than the ballot and is often more influential.
The Assassination is almost universally denigrated as a "cowardly act" (as President Bush described Bhutto's killing yesterday). But the historical record shows it to be a dramatic, low-cost, highly symbolic means of communication -- and murder -- that disaffected people use to try to dramatically sway national or even international affairs. It can work or backfire or just disappear, like a bloody drop in a bucket. Pakistan will be unstable in the coming days, as it has been in the past and will be again. Who can say if Bhutto's slaying is the pinball that leads to destruction, the painful agent of positive change, or just a killing, like most, full of sound and fury and signifying nothing more than murderous nihilism?
The descent into regional conflagration could have been triggered "by 'shock and awe' in Iraq, or the assassination of [Mr. Elie Hobeika] in Lebanon in 24/01/2002, or what ensued with the planned chaos in Lebanon, by the US and Israeli Neocons, Israel's battles with Hezbollah," says Mustafa Aksakal, assistant professor of history at American University, who is writing a book about the Ottoman Empire's descent into World War I. "But the region has so far been able to absorb these shocks. It's just impossible to say what will be the straw that breaks the camel's back." "Anyone who thinks they can predict the consequences of a political assassination is a damn fool," says Eric Rauchway, author of "Murdering McKinley: The Making of Teddy Roosevelt's America" and a history professor at the University of California, Davis. Did Marcus Junius Brutus, when he pulled out his blade to join in the murder of his one-time friend Julius Caesar, understand that his actions would produce (a) perhaps the most famous and influential political assassinations in western history; (b) one of the immortal lines of betrayal -- "Et tu, Brute?" -- that echoes in the cultural id more than 2,000 years later; (c) his own ignominy and suicide?
On the evening of Jan. 30, 1948, a radical Hindu newspaper editor named Nathuram Godse pulled out a pistol and approached a little old man on his way to prayer service. In the instant before he pulled the trigger, he certainly intended to kill Mohandas Karamchand Gandhi, at whom he was enraged for his role in the partition of India and Pakistan. But did he know that by so doing he would turn the diminutive weaver of cotton into the "Father of India" and a global icon of nonviolent resistance?
But these killings were nothing close to the most murderously effective. The dubious title goes to Gavrilo Princip, the Serbian nationalist.
Standing at a stone bridge in Sarajevo in late June 1914, Princip shot Austrian Archduke Franz Ferdinand (and his wife) to demonstrate that he and his compatriots wanted to be freed of the constraints of the Austro-Hungarian Empire and to join neighboring Serbia. What did he know? He was scarcely 20 years old.
But his act of assassination worked; it led to Austria pulling out of Bosnia. The collateral damage was that it ignited World War I.
In the next four years, some 16 nations lost more than 10 million lives, twice that many were wounded, the entire Austro-Hungarian Empire collapsed, Germany was humiliated in defeat (laying the groundwork for the rise of Hitler, World War II and the Holocaust) and America was launched into world prominence.
Princip's pistol also led to the creation of Yugoslavia, which led to the destruction of Yugoslavia, which led to another war involving ethnic Serbs in Bosnia, which led to mass murder of Muslim men and boys in Srebrenica, which led to U.S. troops landing in a place called Tuzla, which led to war crimes tribunals and the imprisonment and subsequent death of the Serbian president who had started the war on ethnic nationalism.
From 'Peace Prize' to burial Moving south, if one wants the short course on why peace in the Middle East is so elusive, just look up "Nobel Peace Prize," followed by "assassination."
Egyptian President Anwar Sadat won that award in 1978, along with Israeli Prime Minister Menachem Begin, for their peace agreement, the Camp David Accords. That lasted for three years, until Muslim fundamentalists stormed a parade route and shot Sadat to death.
Thirteen years later, Israeli Prime Minister Yitzhak Rabin (and colleague Shimon Peres) shared the Nobel Peace Prize with Rabin's mortal enemy, Palestinian Liberation Organization Chairman Yasser Arafat. The two men had, mostly in secret, brokered a peace agreement (the Oslo Accords) that promised to have a transformative effect on the Middle East. But it was largely an agreement between two men, not two nations. One Israeli law student thought that Rabin, a soldier who had defended Israel almost his entire adult life, was "giving our country to the Arabs." He took it upon himself to shoot and kill Rabin.
The Oslo Accords withered and died.
And, of course, there is the United States, where roughly one out of every 11 presidents have been assassinated, where Nobel Peace Prize Laureate Martin Luther King followed the teachings of Mahatma Gandhi and was, of course, shot in the head at the Lorraine Motel in Memphis.
American assassination has been of titanic import. Lincoln's changed the course of the country. His assassination spot at Ford's Theater is a national landmark, and there is the Lincoln Monument on the Mall, not to mention his likeness on the penny and the $5 bill. John F. Kennedy's assassination . . . oh. You've heard.
It's also been almost inconsequential. Just 16 years after Lincoln was killed, James Garfield was assassinated at a train station a few hundred yards from Ford's Theatre. That building, never designated anything, was torn down 99 years ago. The site eventually became the National Gallery of Art and today, not even a plaque marks the spot. The sole reminder of the event is Garfield's unobtrusive statue at the base of Capitol Hill.
In 1998, the U.S. Justice Department published something called the "Exceptional Case Study Project," as part of a threat assessment guide for law enforcement officials. The study reviewed the historical record back to 1835 and surveyed "the thinking and behavior of all 83 persons known to have attacked or approached to attack a prominent public official or figure in the United States from 1949 to 1996."
They fit no one profile, authors Robert A. Fein and Bryan Vossekuil found. Some had political beliefs, some were just nuts. The serious ones kept their mouths shut: "None of the 43 assassins and attackers communicated a direct threat to the target before their attack."
And some, perhaps like the person or people who killed Bhutto yesterday, wanted to "save the country or the world; to fix a world problem."
How seldom it works out that way.?

Bush yesterday lambasted Syria's President Bashar Assad, saying his "patience ran out with [Assad] a long time ago." However, Assad can point to the December 12, 2007, car bombing assassination of Lebanese Army operations chief General Francois al-Hajj as proof that it has not been Syria that has been behind the spate of car bombings in Lebanon that not only aim to destabilize Lebanon but are designed to provide a pretext for a military attack by the United States or Israel or both on Syria.
Al-Hajj was tapped to become the Lebanese Army chief after its current chief, Michael Suleiman, was elected President. However, that move was not popular in Jerusalem or Washington. Al-Hajj was not only friendly to the Syrians but an ally of retired General Michel Aoun, who has struck an alliance with Lebanese Hezbollah leader Hassan Nasrallah. At first, the neocon cabal attempted to pin the al-Hajj car bombing on Syria and its allies in Lebanon. However, the assassination of al-Hajj has all the markings of past Israeli car bombings in Lebanon that have killed scores of Lebanese politicians and journalists. The hit on al-Hajj was practically a carbon copy of the 2002 car bombing assassination of Lebanese political leader Elie Hobeika, who was prepared to testify against Israeli Prime Minister Ariel Sharon for his past war crimes in Lebanon.
The car bombing hits on Hobeika and al-Hajj were a few miles apart in the supposedly secure executive area of Baadba/Hazmieh in Beirut. In both bombings, the same type of shaped charge was used. However, in al-Hajj's case, the bomb used was twice the explosive charge used in Hobeika's assassination. That is because al-Hajj was targeted in a more open area with less adjacent buildings, making it necessary to use a charge of almost 40 kilograms, while Hobeika was car bombed in an area with a number of closely-packed buildings, requiring a charge of merely 20 kilograms. Al-Hajj, a Maronite Christian hailing from south Lebanon who transcended the religious and political divide, was considered a potential president of Lebanon. And because al-Hajj was friendly to Aoun, and, by default Nasrallah, as well as Syria, he had to be disposed of by the neocon cabals in Jerusalem and Washington. WMR has learned of Israeli and American involvement in repeated car bombing assassinations and attempted assassinations by a number of sources in Lebanon, including Christian and Muslim officials in the media and Lebanese intelligence and security services, as well as US intelligence sources in Washington.
In 2005, Lebanon's pro-Syrian Defense Minister Elias Murr, narrowly escaped assassination in a car bombing. Former Prime Minister Rafik Hariri and Lebanese Communist Party leader George Hawi were not so fortunate. Both were assassinated in the Israeli-trademark car bombings.
Declassified CIA files contain an obscure article from the December 12, 1973 issue of the National Guardian. The article describes the CIA's "bomb school" operated by the US Agency for International Development's (USAID) Office of Public Safety at the US Border Patrol Academy in Los Fresnos, Texas.
The program was actually a CIA front for training foreign police officers in the art of setting off bombs in terrorist attacks. As of the date of the article, 165 policemen from several Third World nations had been trained since 1969 in the design, manufacture, and uses of powerful homemade bombs and incendiary devices by CIA instructors operating through the auspices of CIA front organizations, including the International Police Academy (IPA) in Washington, DC, as well as the USAID cut-out.
Dubbed a "technical investigations course," the four-week CIA training through the IPA in Washington included such modules as electricity as applied to explosives, basic bombs and explosives, incendiaries, and assassination weapons.
After classroom training, the students were sent to Los Fresnos for field sessions taught by CIA instructors. Subjects taught included explosives characteristics, electric priming, electric firing devices, explosive charges, homemade weapons, fabrication of devices, functioning of devices, incendiaries, and the placing of bombs in cars, buildings, and public plazas. The Department of Defense found the instruction so disturbing and out-of-bounds, it refused to provide instructors for the course. South Dakota Democratic Senator James Abourezk launched an investigation of the school.
Many of the trainees came from Uruguay where some of the policemen were working as terrorists for the death squads. Similarly, graduates of the bomb school went on to work for death squads in Brazil, Dominican Republic (La Banda), and Guatemala (La Mano Blanca and Ojo por Ojo).
Uruguay and Argentina are currently investigating Henry Kissinger's role in an alliance of Latin American death squads code-named "Operation Condor." Policemen from Saudi Arabia, Jordan, Chile, Brazil, Guatemala, Dominican Republic, Bolivia, Thailand, the Philippines, Iran, South Korea, Colombia, Indonesia, Peru, Ecuador, El Salvador, Honduras, Mexico, Nicaragua, Panama, Venezuela, Paraguay, Argentina, Costa Rica, Burma, Cambodia, South Vietnam, Guam, Cambodia, Guyana, Jamaica, Trinidad and Tobago, Tunisia, Upper Volta, Chad, Dahomey, Ivory Coast, Ethiopia, Ghana, Liberia, Libya, Malagasy Republic, Kenya, and Zaire received bomb making and use training.
Although the CIA Bomb School at Los Fresnos was closed in 1974, there is a belief it moved to the School of the Americas at Fort Benning, Georgia. There is also a distinct possibility that some of the bomb training has been outsourced to private military contractors, such as Blackwater, or its many "local" equivalents in Lebanon... today, trained in IRAQ, or yesterday in Israel or USA....

Israel/MOSSAD/CIA/NI, In Charge Of The US Military Dictatorship. If "Terror" attacks were to stop, then Israel would lack any viable excuse to continue killing Arabs. The bulldozers would fall silent. For Israel, that would be the worst thing that could happen. Even worse than the so-called "Road Map." In America, the Religious Right mandates Bush that the "Holy Land" must be purged of all Muslim Arabs. They cite that act as a Christian Religious Edict, supported by their interpretation of Biblical Scripture. Bush cannot be reelected without their support, nor can he be reelected without Jewish support. Ariel Sharon is not a Religious man, he is a violent psychopath, a butcher, murderer and serial Killer from his teens, and he has stated that he would not form a Government if he had to form a coalition with Orthodox Religious Jews, or any other Jewish Religious groups. Obviously, Sharon is ruthless, controls Israeli Intelligence, and that Service readily admits it has "operatives" inside all Arab Organizations. Israeli Intelligence is rated the best in the world, with complete! access to American Intelligence, and they are not shackled by any sort of morality. The time has come to put 2+2 together and understand where "World Terrorism" is originating or being exploited, and the purpose it serves. Bin Laden may have started this process, but Israelis understand how to use it to further their ambitions. Suicide bombers can be either manipulated, or used as "scapegoats" for any explosion. ( Israelis claimed the last Bus bombing was caused by a bomber entering the front of the Bus, yet the photographs show the roof of the Bus pealed back from the rear, where the charge was set) Their first step was to equate Palestinian resistance, doubted "Terrorism" to 9-11 as being a "Terrorist" act, rather than its actual purpose of being an act of retaliation for America's support of years of Israeli Atrocities. Bin Laden gave the Israelis, unwittingly, exactly what they needed, to expand their naming of "Terrorism" to include 9-11, as well as Palestinian resistance. With most Americans unaware of Israeli atrocities against Palestinians, Israeli theft of Palestinian homes and farms and only understanding Palestinians only as "Terrorists," rather than in a Resistance Movement. The stage was set.
The War against "World Terrorism," as it is now called, had the flags flying, and the full support of the American People. For Americans, Pearl Harbor was back. Not many Flags for Iraq, are people catching on? Sharon was left with the simple task of mobilizing a simpler-minded Bush into an all-out Christian Crusade: First Afghanistan, then Iraq, Lebanon,Syria, Saudi Arabia, Jordan, and finally Iran. "Terrorism" could have been stopped in its tracks by reining in Israel, and although Bush did try, Sharon is far too clever and powerful vis-a-vis Bush Jr. Just to teach Bush a lesson, Sharon made him cough-up 10 billion, a 400% increase in US aid to Israel. Israel's stock-pile of Nuclear Weapons may not be needed after all. "World Terrorism" has caused the United States to form the Office of "Homeland Security" which allows the US Government to suspend all civil rights and Constitutional Protections of American Citizens. At that point, the United States has become a Military Dictatorship, and with the Zionists in control of American Politics, Israel becomes, de facto, the World's only Superpower. The worst thing, that could happen, is happening. Remember that a dictatorship starts with the phrase "the powerful eventually enslave themselves.." from a Dr. Who episode of Warrior's gate. If we really want the United States to keep a constitutional country of law, then we need to drop the religious discussion. In the constitution, it is stated that Church and State are to remain separate. From my reading, it also means that church and state are to stay at arm's length. So, the first we need to do is speak specifically on what legal issues of the constitution are being abated or diminished and how to restore them. In Freedom, the constitution come first not the Bible as the law of the land. I will gladly defend Lebanon and the New Civil Constitution, but I will not defend a theocratic or religious, sectarian state.... American Military Versus Israel Firsters As the White House and Congress escalate their economic sanctions and military threats against Iran, top military commanders and Pentagon officials have launched a counter-offensive, concocting a new Middle East War.... with FDDC. «الطائف» و«الاتفاق الثلاثي»
لا يمكن الحديث عن تهميش الدور المسيحي في لبنان دون ذكر اتفاق الطائف الذي شلح المسيحيين الدور والموقع والصلاحيات الى دون مستوى الشراكة الحقيقية.
وبعد أكثر من سنة ونصف على قيام حكومة السنيورة تتصاعد الشكوى من استمرار التهميش الذي أكدت عليه خطب البطريرك والذي قبل به جعجع منذ اليوم الأول حجماً تمثيلياً هو 24/1 وبحقيبة هامشية كوزارة السياحة
ويستذكر قادة مسيحيون أن مضمون الشراكة المسيحية في النظام الطائفي رسمته معادلات الاتفاق الثلاثي مقارنة بواقع الطائف، والذي في كل الاحوال حتى ولو احسن تطبيقه حرفياً لا يعطي التمثيل المسيحي في السلطة حجماً حقيقياً وموقعاً في الحياة الداخلية وصلاحيات دستورية في عمل النظام بمقدار ما كان سيؤمنه الاتفاق الثلاثي الذي كرس بالتفصيل صيغة «المثالثة» في المواقع وفي الشراكة، وتعامل مع المواقع المسيحية في السلطة على قدم المساواة في الاحجام والصلاحيات مع المواقع السنية والشيعية، وكان ذلك نتيجة مفاوضات صعبة وشاقة قادها ايلي حبيقة بحرص شديد رافضاً أي تصرف «الحاقي» في اي مواقع طائفية اخرى تمثل المسيحيين وأي تغاضى في حجم العلاقات والدور في تركيبة السلطة التي أقرها الاتفاق الثلاثي. كما يقول أحد المسيحيين الحقوقيين المهتمين في اجراء مقارنات في الصلاحية بين ما تبقى لرئاسة الجمهورية في نصوص الطائف او بين الموقع الرئيسي المتساوي مع الموقعين الشيعي والسني في الصيغة التي توصل لها الاتفاق الثلاثي والتي وضعت في هيئة مجلس رئاسي، وبالتالي فان انقلاب جعجع على الاتفاق الثلاثي ادخل المسيحيين في حالة من الاستنزاف عبرت عنها الحرب التي شنت ضد العماد عون واضطرته الى مغادرة البلاد. وكانت الثمرة اتفاق الطائف، ولو جاز للمسيحيين ان يعينوا المسؤول عن خفض سقف الدور المسيحي في النظام اللبناني الى ما دون التسوية التي ابرمها حبيقة في الاتفاق الثلاثي، فان جعجع بنظرهم هو المسؤول مرتين، المرة الأولى عندما انقلب على الاتفاق الثلاثي والمرة الثانية لانه أعطى الفرصة لحرب داخل المناطق المسيحية ووافق على السقف الادنى الذي قلص صلاحيات رئيس الجمهورية لصالح حلفائه في الطائفة السنية، بينما بقي حبيقة على قناعاته وثوابته واسس حزب «الوعد» رافضاً مصادرة اسم القوات اللبنانية احتراماً ووفاء لدور بشير الجميل مؤسس القوات اللبنانية معتبراً أن عائلة بشير وابنه هما الاحق بالتسمية، كما رفض مصادرة اسم حزب الكتائب احتراماً ووفاء لدور بيار الجميل ونجله امين وعندما حاول كشف خيوط مجزرة صبرا وشاتيلا التي لاحقته «كالظل» سقط شهيداً «مظلوماً».
والآن في ظل ما تشهده البلاد يحاول المسيحيون ان يتذكروا تلك الحقبة والمرحلة التي ظلمها البعض في حينه، وجاءت النتائج والانجازات بعد 23 سنة دون المستوى بكثير.. فهل يتعظ البعض.

1) United States must negotiate peace with the countries in the Middle East, especially Iran and Syria. Not only would this give the United States leverage to convince these groups to put a halt to covert funding of groups behind suicide bombings. But it sometimes seems as if these groups are funded solely because they attack Israel, ally of the United States. Regarding many of the groups behind the suicide bombings, Arafat really has little or no control over those organizations, and yet the suicide bombings must stop if peace is to be achieved. What follows is a brief overview of the main groups :
a. Hamas or Islamic Resistance Movement (Harakat al-Muqawamah al-Islamiyya), a wing of the Muslim Brotherhood (an Islamist group founded in Egypt as a response to Nasser's secular pan-Arabism), has the stated goal of the destruction of Israel and the creation of an Islamic state. Hamas does not accept Arafat's leadership, in part because he is a secular leader, and in part due to a schism relating to the peace process. Hamas is the second most powerful Palestinian group, after Arafat's Fatah party, and it is possible that the leadership of Palestine could fall to a member of this group if a chain of succession is not set up within Fatah. b. Hizbollah (Party of God), this shi'ite Resistance group operating from Lebanon, was originally funded by Iran, with logistical help from Syria. Hizbollah was originally created in response to the Lebanese civil war, and still received a great deal of funding and leadership from Iran. They also desire a change from feudal sectarian system, to a stable Republic . c. Islamic Jihad (al-Jihad) has the stated goal of the overthrow Israel as well as secular Arab governments. Islamic Jihad receives support and support from Iran as well as other Arab countries. d. Al-Aqsa Martyrs Brigade is an unofficial wing of Arafat's Fatah group, and was created after the last Intifada in response to the success of Hamas and Hezbollah. What is so unusual about this group is that they are secular when compared to the other groups, with their goal being a Palestinian, but not an Islamic, state. The secularism of this group, as well as they fact that they are the only group with female bombers, brings a new dimension to the suicide bombings, and says something about the situation; the movement is not only religious but is in some quarters wholly political. Yasser Arafat has little or no control of the majority of these groups, and so Sharon's constant demands that Arafat to put a halt to the bombings will accomplish nothing, because Arafat does not, and can not control most of these groups, and in most cases the peace agenda is contradictory to the goals of the military wings of these groups. The only way to put a halt to these radical groups is to cut off their international funding and support, and the only way to accomplish that is to make peace with the countries that sponsor those groups. (This is all in addition to the fact that the United States needs to pull its head out of the international political sand and realize that we cannot have things our way, with brutal murders and assassinations of everyone who does not accept our Dictates all the time. We are a super power not a recalcitrant two year old.)
2) Jerusalem should be under the control of the United Nations, for several years until it is able to take control, as an independent city, somewhat akin to Vatican City. There will never be peace in the Middle East until the issue of Jerusalem is resolved. United Nations control of an independent Jerusalem would be required for several years to keep the peace. During this time, illegal Jewish building projects in Arab areas must be halted, and control given back to Palestinians in the Arab portions of the city. After such a time as it would take for tempers to cool and saner heads prevail, a council, similar to what has been used before, would rule the city, populated by members of all three faiths, perhaps 40% Muslim, 40% Jewish and 10% Christian. Although it would be more democratic to the set the control along population percentages, such a solution that might allow either the Jews or the Muslims control would simply not work, at least until relations have dramatically improved between those groups, because much like the situation regarding the Church of the Holy Sepulcher and the various Christian sects, one group can not be trusted to treat the others fairly.
3) Israeli withdrawal to United Nations sanctioned borders. The United Nations Security Council Resolution 242:
Affirms that the fulfillment of Charter principles requires the establishment of a just and lasting peace in the Middle East which should include the application of both the following principles:
Withdrawal of Israeli armed forces from territories occupied in the recent conflict;
Termination of all claims or states of belligerency and respect for and acknowledgment of the sovereignty, territorial integrity and political independence of every State in the area and their right to live in peace within secure and recognized boundaries free from threats or acts of force; This would require a withdrawal from the West Bank, Golan Heights and Gaza. Jerusalem, as previous mentioned, would be under international control. There is also a probable need for international troops to remain along these borders until tensions have cooled to a significant degree.
4) Major modification of the Right of Return versus the Law of Return. The Law of Return grants every Jew the right to go to Israel as an oleh (Jewish immigrant), and the Israel Nationality Law automatically confers Israeli nationality on every oleh upon entering the country unless he specifies otherwise. The law even provides that a Jew who expresses his desire to settle in Israel may be granted nationality by virtue of the Law of Return even before he physically immigrates. Contrasted with this, Palestinians who fled areas of fighting, or had the lands taken by force by the Israeli government, are forbidden to return to their lands and have yet to receive compensation for the loss of their lands. In addition, many Arabs who remain in Israel fear that if they leave they will also be unable to return, and may also suffer the loss of their homes and lands. The Right of Return, or at the very least compensation, must be given those Palestinians who fled or were forced from their homes.
5) Major modification of water rights. One Israeli kibbutz uses as much water as forty average sized Palestinian villages. Palestinians collect rain for their drinking water, while Israelis have swimming pools and green lawns. (http://www.loe.org/series/troubled.htm) Such an unequal allocation of water resources is untenable. No country can grow without fresh water resources, and access to clean water is a basic human requirement. It is impossible to achieve a modern state without education, it is impossible to achieve education without health, and it is impossible to achieve health without clean drinking water. This basic right, to clean water, stands in the way of peace and prosperity in the Middle East. I believe that the Palestinian population will remain in poverty, ill health, and susceptible to the messages of radical groups until the issue of water rights and access is resolved.
6) Arafat and Sharon should both be brought before a war crimes tribunal for their actions starting with Lebanon and moving forward to the current Intifada. Allowing these two to escape retribution only furthers hostility, and sends a message to the international community that the ends do justify the means.

--Jonathan Swift To be honest, I am not sure that even those drastic measures would work, and I am pretty sure that the United States has little interest in either making peace with any members of the “Axis of Evil” or in partaking in an international presence along an Israeli-Palestinian border, and I fear that without United States and international involvement and intervention, any peace process will be doomed to failure from the start.
I was listening to the news over the weekend, and they were interviewing some of the business owners in Ramallah who are finally able to return to their stores after the curfew and siege were lifted, only to discover that everything was looted or destroyed, ostensibly by the Israeli soldiers. One gentleman, the owner of a cyber café and computer store, said that there was not a single piece of equipment left whole, that everything he owned had been destroyed, and he was now completely bankrupt. What I found most disturbing about the interview was that the gentleman, quite obviously educated and savvy, said that he now clearly understood what motivated the suicide bombers.
Looking at Ramallah and Jaffa and other such areas of contention, it is clear that Israel, instead of solving problems, is only creating more hatred and fueling the radicals, a situation that is counter to every peace goal they claim they are attempting to make. Changes must be made, both by the Israel and Palestinian governments and in the attitudes of the Israeli and Palestinian people is the situation is to be resolved.

شهد الوطن في الأيام الأخيرة إنجازاً مهماً للجيش, تمثل في كشف خلية عدوة خطيرة, حيث أن مديرية المخابرات في الجيش إستطاعت وبكفاءة عالية أن تكشف شبكة تجسس على قدر كبير من الخطورة, تعمل لمصلحة العدو الإسرائيلي. فالشبكة ونظراً لطبيعة المهام التي كلفت بها من قبل العدو قد تعتبر الأخطر وهي جديدة من نوعها ضمن شبكات التجسس التي اكتشفت حتى الآن في لبنان, وأخطر ما فيها مهامها الشبابية والعلمية والإقتصادية والمالية.
لو اجرينا قراءة هادئة للموضوع, نستطيع أن نصل بالفكر المتجرد الى القول بأن العدو الإسرائيلي المهزوم حقاً في لبنان, يئس من اللبنانيين أمنياً وعسكرياً. فكل طاقاته وإمكاناته العسكرية لم توفر له نصراً في لبنان على مدى نيف وعشرين عاما,ًُ وقد خرج منذ عامين تقريبا مدحوراً مهزوماً ميدانياً. واستمرت التداعيات في الذهنية الإسرائيلية لتخلق حالة يأس داخل مؤسسة العدو العسكرية من أي عمل أمني أو إقتحام أمني للبنان, وهذا نصر يستطيع كل من ينتمي للبنان أو للعرب أن يفاخر به. فنحن في لبنان لم نهزم العدو فقط في الميدان, بل هزمناه في نفسه وفي ذهنه حتى أضحى الواقع اللبناني والمثل اللبناني هاجساً للعدو.
كذلك غير العدو الإسرائيلي نمط تعاونه معنا, واختار ميادين اخرى, الشخص البسيط يراها تافهة والشخص العادي يراها مهمة والشخص ذو الفكر والبعد الإستراتيجي يراها في منتهى الخطورة, فهي أخطر من العمل العسكري والأمني المباشر.
لقد اختار دراسة الشباب في الخارج وحركتهم في الداخل والعمل والنشاط الإقتصادي والإدارة المالية؛ واذا أجرينا كما قلت قراءة هادئة لهذه الأمور ندرك حجم مخاطرها.
فأي عمل تقوم به بحاجة الى أمرين: الطاقة المحركة والمادة المحركة.
المادة المحركة تحققها بالمال وتوفرها ضمن علاقاتك الإقتصادية, والطاقة المحركة هي الطاقة البدنية ذات الخبرة أو من دونها أي الطاقة العادية, والتي هي الشباب في الحالين. اذاً توجه العدو الى الطاقة المحركة والمادة المحركة أي الى وسائل التقدم.
بدأ بجمع المعلومات عبر الشبكة السيئة الذكر بعناصرها. لماذا يجمع هذه المعلومات؟ هل ليغني مجموعات أو موسوعات عالمية بها خدمة إعلامية للبنان؟ طبعاً لا, انه يجمع المعلومات ليحضر القرار الذي يعطل به الطاقة المحركة, أو ليفسد علينا إمكانات إمتلاك المادة المحركة, أو يضرب الاثنين معاً. قد لا يرى الشخص منا أهمية في مسألة جمع المعلومات عن الطلاب اللبنانيين في الإتحاد السوفياتي السابق أو روسيا الحالية أو الصين أو الهند أو باكستان الذين يدرسون العلوم الطبيعية والفيزياء النووية, ولكن لو استعدنا الماضي لوجدنا أن كثيراً من العلماء اللبنانيين في الغرب قتلوا بعد ان وصلوا, ونذكر جميعاً العالم حسن كامل الصبّاح.
أما بالنسبة للإقتصاد فنحن لم ندخل الحرب سنة 1967, وبقي لبنان عسكريا خارج الحرب؛ ولكن لبنان الذي نأى بنفسه عن الميدان, خسر ما يعادل نصف مجموع خسائر الذين حاربوا حيث انهار اقتصادنا بتأثير من اليد الغربية المحركة صهيونياً, وذلك منذ انهيار بنك إنترا وما تبعه.
كان العدو الإسرائيلي يقول سابقاً: اننا لا نحسب للبنان حساباً, وأحد سياسييه كان يقول: انني لا أعرف من الذي سيوقع معاهدة السلام الأولى مع إسرائيل من العرب ولكنني أحدد قطعاً من سيكون الثاني, وكان يقصد لبنان, فبنظرهم أن لبنان نظراً لضعفه ولعدم توفر الطاقة والإمكانات اللازمة للصمود, فهو لن يستطيع أن يواجه إسرائيل, وإسرائيل لن تحسب له حساباً في خانة الأعداء – حسب قولهم.
لكن لبنان عبر تجميع عناصر القوة فيه, تفّه الفكر الصهيوني وتفّه السياسة الصهيونية والإستراتيجية الصهيونية, وهزمهم من الباب الذي لم يكن أحد منهم يحسب له حساباً, في الأمن والميدان, وبات لبنان يشكل بعبعاً لإسرائيل. والأخطر أن لبنان اذا إستعاد وضعه الإقليمي إقتصادياً سيدفن الحلم الإسرائيلي بأن يكون الصهيوني سيد المنطقة والمستأثر بخيراتها, أو في أسوأ الظروف المفوض السامي الغربي, الذي يديرها لمصلحته ولمصلحة الغرب. ان لبنان اذا إستعاد عافيته الإقتصادية سيقضي على هذا الحلم كما قضى على الحلم الإسرائيلي في الأمن مع الأرض.
لهذا, نحن على باب مرحلة جديدة في الصراع مع العدو, ظاهره الهدوء وباطنه النار والجوع. لذلك يستطيع كل منا نحن العسكريين في الجيش اللبناني ان يفاخر بهذا الإنجاز العظيم الذي فضح بدء المخطط الإسرائيلي لإلتهام لبنان علمياً وإقتصادياً. فكما تمكنت المقاومة المدعومة من الجيش والحكم والشقيقة سوريا, ومع ذلك وبعد ذلك, بوحدة الشعب اللبناني, كما تمكنت هذه العناصر الخمسة متضافرة من دفن الحلم الأول, فإن الجيش اللبناني بكشفه هذه الشبكة وبتعهده بمسألة الأمن الحالي والأمن الإقتصادي, فإنه يجهض إمكانات تحقق الحلم الثاني, ويبقى أن يتابع كل في موقعه عمله لدفن هذا الحلم.

يوم برَّأ الفاتيكان اليهود من صلب المسيح حمل الرسالة المسيحية الى طوباوية، تخطّت الذات البشرية، وترفَّعت على الجراح، لتصير حالة مغفرة. قيل يومها ان صفحة جديدة، ونقية، فُتِحت لمصلحة الانسانية جمعاء. لكنها صفحة يصرّ بعض اليهود على ان يكتبوا عليها رسائلهم بحبر العتم، فيقدون المسامير العصرية في جسد المسيح، ويكررون صلبه كل يوم. المسمار الاول كان اسمه «ذي ديفنشي كود». كتاب تحوّل الى فيلم سينمائي، يتحدث بكثير من الوقاحة عن علاقة بين السيد المسيح ومريم المجدلية اثمرت ابنة. المسمار الثاني، كان اسمه «انجيل يهوذا». وتحدث عن وثائق سرية تدور حول الموضوع نفسه، وكلها اساءة الى العقيدة المسيحية. اليوم حضّر لنا اللوبي اليهودي في اميركا مسماراً جديداً، وطويلاً، قرر ان يطلقه يوم الجمعة العظيمة، ويتحدث عن قبر المسيح وعائلته. المسمار الصدئ هذا، فيلم سينمائي عنوانه: «قبر يسوع الضائع»، صوّره مخرج فيلم «التيتانيك». فيلم وثائقي يزعم ان بعثة تنقيب عن الاثار اكتشفت عام 1980، في حيث تالبوت جنوب القدس، قبراً يحتوي رفاة يسوع المسيح «وزوجته» مريم المجدلية «وابنه» يهوذا. في ذاك القبر وجدت عشرة نواويس تعود للقرن الاول للميلاد كُتِبت عليها اسماء يسوع، مريم، يوسف، يهوذا ومتى. وكما في كل مرة غضب الفاتيكان، واعترض الاكليروس، ... وطُعن المصلوب من جديد بحربة عصرية! يوم الجمعة العظيمة اسجد امام قبرك يا يسوع، واغسل قدميك بدموعي. واطلب لهم الغفران. حملت لهم رسالة المحبة فصلبوك! بشرتهم بالخلاص فدقوا المسامير في يديك ورجليك. شفيت اوجاعهم فطعنوك بحربة. اطعمتهم سمكة فقدموا لك حية. وما تزال افاعيهم بعد الفي سنة تخرج من اوكارها لتلسع جسدك المقدس، وتبث سمومها في العالم كله. لكن صليبك هو الرجاء. وهو الاقوى. هو المنتصر من البداية وحتى النهاية. اغفر لهم، ولو انهم يدرون ماذا يفعلون. **********************************************************************************

The relationship between the United States and Syria is still contradictory and obscure. Washington is facing increasing problems in the Middle East. In his speeches, Bush continues to accuse both Iran and Syria of causing instability in Iraq, Lebanon and the Palestinian territories, although some political moves seem to suggest that a distinction has been made between these two countries, because it is clear and obvious that they are partners in some of the covert political assassinations that took place in Lebanon, through manipulations, penetrations of secret services and military intelligence structures in Syria and Lebanon to directly serve US and Israeli interests. Hence, the International tribunal has no legs to stand on as of yet, and the jury is still out to see whether it will ever take shape or where it will be driven to achieve goals which have nothing to do with "Truth", Justice or the like. The obvious game of these parties, "playing enemies" is very very clear and transparent for the world to see.
People tend to forget so quickly that the USA, especially the Pentagon, was the main driving force behind the elimination of the Belgian Law of 2001, which was the main reason for indicting Ariel Sharon for the sabra Shatila Massacre, and the most adamant adversary of such tribunal was the US administration. The US has a long history of opposing such international bodies and such claims to International investigations and criminal courts run by "international judges".... this will not change now, to the contrary the US will do its utmost to KILL any such jurisdictions... and they will do it using the usual proxies to do the dirty work for them, and they will keep pretending to be for Justice, freedom, Peace and democracy, which is utterly False.

It seems that CIA has to find an ongoing "safe" to burry all its dirty laundry in Lebanon... From "VEIL" to MEHLIS ! The clown who was chosen to put his name on this book ( Black Hands ) is a rabid buffoon by the name of Najah Wakim. Just like Naji N. Najjar has done 2 years later with another book, using another criminal idiot as "Author", in a similar Intelligence operation to smear another target for assassination, Mr. Elie Hobeika, as a prelude to a bigger HIT on Rafic Hariri, 3 years later. He masterminded the arrival of Lahoud in 1998, together with CIA. Stories abound in Lebanon about Jameel Al-Sayyed being the "real" President and the real power behind the facade of the Lebanese institutions for years. His "Training in the early 80s, his career path, his personal friendship with Bashar Al-Assad, his known and documented contacts with American and Israeli handlers, speaks volumes about this "classic" manipulation Made In Langley and Herzlia. Emile Lahoud is absolutely perfect for the period 1998/2008, because they know that he is a harmless idiot, and will accept to be completely and utterly manipulated by Jameel-El Sayyed.
Jameel el-Sayyed was the main conduit and mastermind of the Hariri Assassination, which he started planning for since 1998. Jamil El-Sayyed is well known for being extremely smart, intelligent and extremely manipulative. He was/is a FAVORITE of the weasel Walid Joumboulatt, and his main contact and main source of information for years, during the Pax Syro-Americana in Lebanon. Waleed Joumblatt is part and parcel of the Israeli American manipulation to eliminate Rafic Hariri, despite his outward signs of sorrow and fake emotions. Waleed is a master clown in disguise, and a pathological liar, just like his masters in Neoconville. The remaining "tools" are : Geagea the Killer, who did not hesitate in murdering his own brother in law, in front of his son, blowing his brains out... , Amine Gemayel who at the behest of CIA, ordered the terror car bomb of Bir El-Abd, targeting Sheikh Mohammed Hussein Fadlallah in 1985, killing 85 innocent civilians in the process, in retaliation to the Marine Barracks bombing of 1983. A storm ensued in USA at the time, hence the charade of the Book: VEIL authored by Bob Woodward, another CIA asset... According to high level European intelligence officials, Bush's counselor, Karl Rove, used the new presidential authority to silence a popular Lebanese Christian politician who was planning to offer irrefutable evidence that Israeli Prime Minister Ariel Sharon engineered the massacre of hundreds of Palestinian men, women, and children in the Beirut refugee camps of Sabra and Shatilla in 1982. In addition, Sharon provided the SLA forces & IDF who carried out the grisly task. At the time of the massacres, Elie Hobeika was intelligence chief of Lebanese Christian forces in Lebanon who were battling Palestinians and other Muslim groups in a bloody civil war. He was also the chief liaison to Israeli Defense Force (IDF) personnel in Lebanon. An official Israeli inquiry into the massacre at the camps, the Kahan Commission, merely found Sharon "indirectly" responsible for the slaughter and fingered Hobeika as the chief instigator, while in fact Mr. Elie Hobeika was never anywhere near Sabra or Shatila in Sep. 82, he was very busy investigating the assassination of President elect Bashir Gemayel .
The Sabra and Shatila Massacre was planned within the Invasion plans of the IDF in 1982 when it invaded Lebanon, and it appears under the name of Operation Spark, and Operation Iron Brain.
Its finer details were worked out between the 1st of September when the alliance with Bashir collapsed, and the 12th of the same month when Sharon met with Bashir. The LF was perceived as unreliable and that the mopping up of the camps was to proceed with or without them. AMAN could rely on the SLA to get the job done, and it would assist them with IDF Special Forces, or Sayerets as they are called in Hebrew. It is quite clear that the Sayerets were in the camps as the former fighters in the camp have told us repeatedly . But the presence of the Sayerets indicates clearly that the Massacre was what is called in intelligence lingo a Black Operation, which is a secret operation that is carried out by the intelligence agents and special forces upon a decision taken by the Chief Executive and a few of his ministers. Israeli Secret Services and the Sayerets have carried out many Black Operations, including the Qibya Massacre of 1953, the attack on the Beirut International Airport in 1968, and the assassination of Abu Jihad in Tunisia, 1988. During the 1982 Invasion, and according to IDF historian Samuel Katz, the Sayerets were deeply involved in the military operations. These forces,which like all Special Forces in the world, are made up of hard brutal killers, who volunteer for the job and know exactly what it entails.
In short, Israel's Secret Services' role in Sabra and Shatilla Massacre is not only undeniable, but is far more involved than what "Kahan Commission" stated. One day when Appendix B finally comes to light, this theory will be proven, although it is clear that there is enough evidence to back it up. As an epilogue, Israel's secret services, CIA & the Mossad, assassinated Elie Hobeika in Beirut in 2002, using CIA & local witting proxies, in what is obviously an attempt to conceal the truth about the Massacre. If anyone doubted the involvement of the Israeli intelligence, this should silence the naysayers. Mr. Elie Hobeika Never set foot at Sabra & Shatila in September of 1982, nor had anything to do with that horrible crime, in any way shape or form. It was an IDF operation with AMAN and MOSSAD at the Helm. Besides Sayyeret Metkal's units in the camps, there were three additional units which came from 3 different entrances to the camps, and the SLA forces of Saad Haddad, brought into Beirut by IDF. ALL these units were under direct orders of IDF officers, and IDF troops were totally occupying Beirut militarily . The First unit was lead by Z.M. , The second unit was lead by M.M. and the 3rd by C.G. It is noteworthy to say that M.M. had met and had dinner with B.N. in his home in west Beirut, before entering the camps, he dined and spent the night there....but these units were brought in the camps on the last day of the operations, to set them up for the world media to see and portray as if they were the instigators. Combatants who were there said that upon arrival to the camps, they were shocked to see all the killings, because ALL of these units arrived there when the Sayyarets had finished the job completely with the SLA forces of Saad Haddad. These are eye witness accounts. Those LF will be forced into the mountain war within few months, and a new trap will be set up for them by IDF, whereby eye witness accounts say that every time they advanced into a new village, winning a very bloody battle with casualties, orders will come for them to retreat from IDF officers. In some cases IDF artillery were shooting at both sides,reigniting the battles again and again. Thousands of Christians were massacred, their villages in ruins in a futile fight until exhaustion and complete retreat. This is the legacy of IDF in Lebanon over 40 years.
The Kahan Commission never called on Hobeika to offer testimony in his defense. However, in response to charges brought against Sharon before a special war crimes court in Belgium, Hobeika was urged to testify against Sharon, according to well-informed Lebanese sources. Hobeika was prepared to offer a different version of events than what was contained in the Kahan report. A 1993 Belgian law permitting human rights prosecutions was unusual in that non-Belgians could be tried for violations against other non-Belgians in a Belgian court. Under pressure from the Bush administration, the law was severely amended and the extra territoriality provisions were curtailed.
Hobeika headed the Lebanese forces intelligence agency since the mid- 1970s and he soon developed close ties to the CIA. He was a frequent visitor to the CIA's headquarters at Langley, Virginia. After the Syrian invasion of Lebanon in 1990, Hobeika held a number of cabinet positions in the Lebanese government, a proxy for the Syrian occupation authorities. He also served in the parliament. In July 2001, Hobeika called a press conference and announced he was prepared to testify against Sharon in Belgium and revealed that he had evidence of what actually occurred in Sabra and Shatilla. Hobeika also indicated that Israel had flown members of the South Lebanon Army (SLA) into Beirut International Airport in an Israeli Air Force C130 transport plane, in full view of dozens of witnesses, including members of the Lebanese army and others. SLA troops under the command of Major Saad Haddad were slipped into the camps to commit the massacres. The SLA troops were under the direct command of Ariel Sharon and an Israeli Mossad agent provocateur named Rafi Eitan. Hobeika offered evidence that a former U.S. ambassador to Lebanon was aware of the Israeli plot. In addition, the IDF had placed a camera in a strategic position to film the Sabra and Shatilla massacres. Hobeika was going to ask that the footage be released as part of the investigation of Sharon.
After announcing he was willing to testify against Sharon, Hobeika became fearful for his safety and began taking precautionary moves. Hobeika was not aware that his threats to testify against Sharon had triggered a series of fateful events that reached well into the White House and Sharon's office. On Jan. 24, 2002, Hobeika's car was blown up by a remote controlled bomb placed in a parked Mercedes along a street in the Hazmieh section of Beirut. The blast was a "cone-shaped charge" that used "moldable high explosives such as SEMTEX H," shaped to create a high-speed, high temperature blast wave. The blast took place in two stages over a fraction of a second. During the first stage, the blast "forces all the air out with tremendous force," creating a vacuum, but as air rushes back in, it creates another tremendous force that causes further damage. "It's a trademark of bombs made by CIA and the Pentagon", in their regular training of proxy forces over the years, in various exchanges of military expertise with Lebanese Army Intelligence, and the Lebanese forces in the 1980s, and elsewhere in the world. Such expertise was deliberately aimed at eliminating Sheikh Muhammad Hussein Fadlallah, the chief interpreter of Islamic law for the Shia'. An attempt was made on Fadlallah's life on March 8, 1985, when an explosive-packed car was driven into a Beirut suburb about 50 yards from Fadlallah's residence. The car disappeared in a blinding blue flash that killed 85 people and wounded 200 more. Longs weeks of training were carried out in various places, including Safra, where Israeli and American expertise was also brought to bear, in order to insure success for this major operation of CIA and MOSSAD, with Lebanese Army Intelligence, and it was supposed to be a revenge for the Marine Barracks Bombing of 1983, in which 241 service members died in a suicide operation, believed to have been carried out by Hizbullah in its infancy.... This operation was a total failure, and Sheikh Muhammad Hussein Fadlallah survived miraculously, but the whole neighborhood was devastated. CIA scrambled in Washington Dc and elsewhere to cover their tracks and hide all evidence of their DIRECT involvement in this operation from the US Congress, hence a book was written then, by BOB WOODWARD, "VEIL" to fabricate a story about this US/Israeli operation. It is interesting that Sheikh Fadlallah read Woodward's book and cites its content in some of his interviews.... Hizbullah tracked several of the "executors" of the operations, and at least 2 of them were executed.... A former State Department official said that the group behind the bombing had been trained in the United States, and that there was direct American involvement in the assassination attempt, CIA and Lebanese Army Intelligence, headed then by Officer Johnny ABDO, during the tenure of Amine Gemayel, and on direct orders from President Amine Gemayel. Both Johnny Abdo and Amine Gemayel were/are, the Darlings of all American Administrations until today.... The bomb exploded when Hobeika and his three associates, Fares Souweidan, Mitri Ajram, and Waleed Zein, were driving their Range Rover past the C4-laden Mercedes at 9:20 am Beirut time. The Range Rover's four passengers were killed in the explosion. In case Hobeika's car had taken another route through the neighborhood, two additional parked cars, located at two other choke points, were also rigged with C4. The powerful bomb wounded a number of other people in the vicinity. Other parked cars were destroyed and buildings and homes were damaged. Hafez Assad, had been an ally of Bush's father during Desert Storm, a period that saw Washington give a "wink and a nod" to Syria's occupation of Lebanon. During Hobeika's year 2000 election campaigns for his parliamentary seat, Jason was often in Hobeika's office offering support and advice. After Hobeika's assassination, Jason became despondent over the death of his colleague. Eventually, Jason disappeared abruptly from Lebanon and reportedly later emerged in Pakistan. Jason was very close to Hobeika. Karl Rove's involvement in the assassination of Hobeika may not have been the last "hit" he ordered to help out Sharon. In March 2002, a few months after Hobeika's assassination, another Lebanese Christian with knowledge of Sharon's involvement in the Sabra and Shatilla massacres was gunned down along with his wife in Sao Paulo, Brazil. A bullet fired at Michael Nassar's car flattened one of his tires. Nassar pulled into a gasoline station for repairs. A professional assassin, firing a gun with a silencer, shot Nassar and his wife in the head, killing them both instantly. The assailant fled and was never captured. Nassar was also involved with the Phalange militia at Sabra and Shatilla. القضـاء العـسكري قـضاء خاص له قـواعده ونظمـه المنصـوص عنها في القانـون رقـم 24/68 الصادر في 13/4/68, أي “قانون القضاء العسكري” (إخـتصاره “ق. ق. ع.”), وهو القانـون الذي يُعـنى أولا ً بتحديد وتنـظيم المحاكـم العسكرية, بما في ذلك الصلاحيات والأصول المتـبعة أمامـها, ويعنى ثانياً بتحـديد العقوبات والجرائم العـسكرية. ولكن تخصـيص القضاء العسـكري بقـواعـد خاصـة لا ينـفي رجوعــه في أكـثر من مـسألة الى قـانون أصول المحاكمات الجزائية والى قانون العـقوبات العـامة؛ فالمحـكمـة العـسكرية تُطبّق قواعد أصول المحاكمـات الجـزائية في كلّ ما لا يتعارض مع أحكام ق. ق. ع., وتطـبق في الجـنايات والجنح العادية (أي تلك المنصوص عنها في قانـون العـقوبات العـام) المحـالة أمامها بحسب قواعد الإختصاص, العـقوبات الأصلية والإضافية والفرعية المنصوص عنها في قانـون العـقوبات؛ مع العـلم أنهـا, وبالنسـبة للعسكريين الذين يرتكـبون هـكذا جـرائم, تُطــبق بحقـهم, إضافـة الى هـذه العـقـوبات, العقـوبـات الفرعـية المنصـوص عنها في ق. ق. ع. وهي التجريد العسكري والعزل وفقـدان الرتبة والطرد... الى ما هنالك من الحالات التي تستـدعي رجـوع المحكمـة العسـكرية الى أحـكام القانون العـادي, أي قانون أصـول المحاكـمات الجزائـية وقانـون العـقوبات العـام. متى تكـون المحكمة العسكرية صالحة للنظر بالدعوى؟ وما هي الجرائم العسكرية؟
ممَ يتألف القضاء العسكري؟
يتألف القضاء العسكري من: - محكمة تمييز عسكرية, مركزها بيروت. - محكمة عسكرية دائمة, مركزها بيروت. - قضاة منفردين عسكريين في المحافظات, تحدد مراكزهم بقرار من وزير الدفاع بناءً على اقتراح السلطة العسكرية العليا. - مفوّض حكومة ومعاونيه. - قضاة تحقيق. يُعطى وزير الدفاع الوطني تجاه المحاكم العسكرية جميع الصلاحيات المعطاة لوزير العدل تجاه المحاكم العدلية, في كل ما لا يتنافى وأحكام ق. ق. ع. في زمن الحرب, يمكن إنشاء محاكم عسكرية مؤقتة خاصة بالقوى المسلحة, وذلك بموجب مرسوم.

ينص ق. ق. ع. على صلاحية المحكمة العسكرية من الناحية الإقليمية, النوعية والشخصية, وفقاً لما يلي: إقليمياً, تشمل صلاحية المحكمة العسكرية الدائمة جميع الأراضي اللبنانية والأراضي الأجنبية التي يحتلها الجيش اللبناني, باستثناء المناطق التي تشملها صلاحية المحكمة العسكرية المؤقتة الخاصة بالقوات المسلحة. أما لناحية الصلاحية النوعية, فتختص المحكمة العسكرية بالنظر في: - الجرائم العسكرية المنصوص عنها في ق. ق. ع. وهي التخلّف والفرار والتسليم والخيانة والمؤامرة العسكرية والتجسس والتمرّد والعصيان... وغيرها. - جرائم الخيانة والتجسس والصلات غير المشروعة بالعدو المنصوص عنها في قانون العقوبات العام, وفي القوانين الخاصة التي تعاقب على هذه الجرائم. ++++++++++++++++++++++++++++++++++++++++++++ - الجرائم المتعلقة بالأسلحة والذخائر الحربية المنصوص عنها في قانون الأسلحة, وذلك ضمن الشروط المحددة قانوناً. - الجرائم المرتكبة في المعسكرات وفي المؤسسات والثكنات العسكرية. - الجرائم الواقعة على شخص أحد العسكريين, باستثناء تلك التي تقع على شخص أحد المجندين ولا تتعلّق بالوظيفة. - الجرائم الواقعة على شخص أحد رجال قوى الأمن الداخلي والأمن العام. - الجرائم الواقعة على الموظفين المدنيين في وزارة الدفاع الوطني والمحاكم العسكرية, أو لدى الجيش وقوى الأمن الداخلي والأمن العام, إذا كانت لهذه الجرائم علاقة بالوظيفة. - جميع الجرائم, مهما كان نوعها, التي تمس مصلحة الجيش أو قوى الأمن الداخلي أو الأمن العام. - الجرائم الواقعة على شخص أحد رجال الجيوش الأجنبية أو التي تمس بمصلحتها, ما لم يكن هناك إتفاق مخالف على تحديد الصلاحية بين الحكومة اللبنانية والسلطة التابعة لها هذه الجيوش. ولجهة الصلاحية الشخصية للمحكمة العسكرية, فينص القانون على أن يحاكم أمام هذه المحكمة, أياً كانت جنسيتهم, وأياً كان نوع الجريمة المسندة إليهم: العسكريون والمماثلون للعسكريين, باستثناء المجندين عند ارتكابهم جرائم لا علاقة لها بالوظيفة. - رجال قوى الأمن الداخلي والأمن العام. - الأسرى. - رجال قوى الجيوش الأجنبية والموظفون المدنيون فيها, ما لم يكن هناك إتفاق مخالف على الصلاحية بهذا الشأن بين الحكومة اللبنانية والسلطات التابعة لها هذه الجيوش الأجنبية. - الموظفون المدنيون لدى وزارة الدفاع الوطني والجيش والمحاكم العسكرية أو قوى الأمن الداخلي أو الأمن العام, إذا كانت جرائمهم ناشئة عن الوظيفة أو واقعة تحت طائلة ق. ق. ع. - كل فاعل أصلي أو شريك أو متدخل أو محرّض في جريمة مُحال بها أمام القضاء العسكري أحد الأشخاص المذكورين أعلاه. إشارة الى أنه بتاريخ 30/6/77, صدر المرسوم الإشتراعي رقم 110 المتعلّق بتحديد صلاحية القضاء العسكري في الجرائم الواقعة على رجال قوى الأمن الداخلي والأمن العام والموظفين المدنيين التابعين لقوى الأمن الداخلي والأمن العام, وقد تمّ تعديله جزئياً عام 1992. من المهم جداً لفت الإنتباه الى أن صلاحية المحكمة العسكرية, من أية درجة كانت, تنحصر بدعوى الحق العام (وهي الدعوى التي ترمي الى توقيع العقوبة بالمجرم), من دون دعوى الحق الشخصي (وهي الدعوى الرامية الى الحصول على التعويض وغير ذلك). ولا يجوز الإستماع الى الشاكي المتضرر إلا على سبيل المعلومات. تُقام دعوى الحق الشخصي أمام المحكمة المدنية الصالحة, ولكن يتوقف صدور الحكم فيها الى أن تفصل دعوى الحق العام نهائياً. إذا لوحق شخص في آن واحد بجرم من صلاحية المحكمة العسكرية وبآخر من صلاحية المحاكم العادية, فإنه يحاكم مبدئياً بكل جرم على حدة من قبل القضاء الصالح. وعلى المحكمة التي تنظر بعد الأولى بالجرم الذي هو من صلاحيتها, أن تبت عند الإقتضاء بجميع العقوبات أو بإدغامها (والإدغام يعني تنفيذ العقوبة المحكوم بها الأشد من دون سواها). أما إذا كان الجرم من نوع الجناية وكان من صلاحية المحكمة العسكرية, فإنها تنظر تبعاً للجناية بسائر الجرائم المتلازمة معها. وفي حال كان الجرم من صلاحية القضاء العادي, وكان ثمة جرم سلاح حربي متلازماً معه, فإن القضاء العادي ينظر بالجرمين معاً.
الجرائم العسكرية
الجرائم العسكرية هي الجرائم المحددة حصراً في الباب الثاني من الكتاب الثالث من ق. ق. ع., وهي تندرج ضمن أربع فئات: - جرائم التملّص من الواجبات العسكرية: التخلّف, الفرار والتشويه الذاتي. - الجرائم المُخلة بالشرف والواجب: التسليم, الخيانة والمؤامرة العسكرية والتجسس, السلب والإتلاف, التدمير, التزوير والغش, السرقة والإختلاس, وإنتحال الألبسة والأوسمة والشارات. - الجرائم المخلة بالإنضباط العسكري: التمرّد, العصيان, رفض الطاعة, التحقير وأعمال الشدة الواقعة على الرؤساء, إساءة إستعمال السلطة, ومخالفة التعليمات العسكرية. - جرائم رجال سلاحي الجو والبحرية. في ما يلي شرح لكل من هذه الجرائم وللعقوبات الملازمة لها, ولكن لا بد قبل ذلك من توضيح الأمور التالية: - بالنسبة للجرائم العسكرية التي خُصصت (في ق. ق. ع.) بالعسكريين فقط, والتي يمكن أن يرتكبها أشخاص مدنيون, تسري أحكام هذا القانون على هؤلاء المدنيين, على أنه يمكن تخفيض العقوبة وفقاً لأسس معينة نصّ عليها القانون نفسه. - إنّ كل الأحكام التالي ذكرها تُطبّق على قوى الأمن الداخلي والأمن العام وأمن الدولة وسائر المماثلين للعسكريين, كما تطبق على العسكريين التابعين للجيوش الحليفة (وذلك عندما تكون المحكمة العسكرية اللبنانية صالحة للنظر بالدعوى). - إن العقاب المفروض على الضابط لارتكابه أياً من الجرائم العسكرية هو في غالب الأحيان أشد من العقوبات المفروضة على العسكري الذي يرتكب الجرم نفسه, وغالباً ما تُفرض على الضابط عقوبة العزل.
جرائم التملّص من الواجبات العسكرية
- التخلّف: يعد متخلفاً ويعاقب بالحبس كل شخص يُدعى للخدمة في الجيش أو للتدريب العسكري (بما في ذلك خدمة العلم) وفقاً للقوانين والأنظمة, ولا يلبي الدعوة بعد إنقضاء تسعة أيام في زمن السلم وثلاثة أيام في زمن الحرب, ولا تحول هذه العقوبة دون فرض العقوبات المسلكية المنصوص عليها في قانون الجيش وقانون الخدمة في الجيش وقانون التدريب العسكري وسائر القوانين العسكرية. من جهة أخرى, تُطبق هذه العقوبات على كل من تفرض عليه تكاليف عسكرية ولا يتقيد بها. - الفرار: - الفرار داخل البلاد: في زمن السلم, يعدّ فاراً الى داخل البلاد: - كل عسكري غاب عن قطعته أو شرذمته, بدون إذن أو عذر شرعي, بعد إنقضاء ستة أيام. - كلّ عسكري سافر من قطعة الى قطعة أو من نقطة الى نقطة, وانتهت رخصته (في حال كان مأذوناً مثلاً أو في مهمة رسمية), ولم يعد الى قطعته أو شرذمته بعد انقضاء تسعة أيام من التاريخ المحدد لعودته. - العسكري الذي لم تمض على وجوده في الخدمة ثلاثة أشهر, وانقضى على غيابه 30 يوماً. يعاقب على الفرار داخل البلاد بالحبس. أما في زمن الحرب, فتخفض المدد المذكورة (ستة أيام, تسعة أيام, وثلاثين يوماً) الى ثلثها (أي يومين, ثلاثة أيام, وعشرة أيام), وتضاعف العقوبة, نظراً لخطورة الوضع. في حال حصول الفرار الى العدو أو أمامه أو بمؤامرة, لا يعتدّ بالمدد المذكورة, بمعنى أن الجرم يعتبر واقعاً, وإن لم تنقض المدة المحددة قانوناً (مثلاً مدة اليومين في حال غياب العسكري عن قطعته بدون إذن أو عذر شرعي, في زمن الحرب... الخ). في كل هذه الحالات, تكون العقوبة أشد من تلك المفروضة في الأحوال العادية, وتصل الى الإعدام في البعض منها. إشارة الى أنه يعد فراراً أمام العدو, الفرار الذي يُقدم عليه العسكري وهو في حالة إشتباك مع العدو, أو على وشك الإشتباك معه, أو بينما كان عرضة لهجماته. ويعد فراراً بمؤامرة, الفرار الحاصل من عسكريين إثنين أو أكثر, بعد إتفاقهم عليه, حتى ولو استسلموا أو قُبض عليهم قبل إنقضاء المدة المحددة قانوناً (كما ذكرنا). - الفرار الى خارج البلاد: في زمن السلم, يعد فاراً الى خارج البلاد كل عسكري يجتاز الحدود اللبنانية بدون إذن, أو يترك قطعته ويلتحق ببلاد أجنبية, وذلك بعد انقضاء ثلاثة أيام على غيابه بدون عذر شرعي. أما في زمن الحرب, فيعدّ فاراً بعد غياب يوم واحد. يعاقب العسكري الفار الى خارج البلاد بالسجن؛ واذا كان الفار ضابطاً, فيعاقب بالإعتقال المؤقت. إشارة الى أن العقوبة المفروضة قانوناً في حالة الفرار الى الخارج هي دائماً أشد من تلك المفروضة في حالة الفرار الى الداخل, وتلك المطبقة في زمن الحرب أشد من تلك المطبقة في زمن السلم. - التشوية الذاتي: كلّ عسكري جعل نفسه غير صالح للخدمة مؤقتاً أو مؤبداً ليتهرب من واجباته العسكرية أو من أي مهمة أو عمل مشروعين كلّف بهما, يعاقب بالحبس. تصل عقوبة جرم التشويه الذاتي الى حدّها الأقصى, أي الى الإعدام, وذلك إذا حصل الجرم أمام العدو. إذا أقدم أحد العسكريين على التدخل في هذا الجرم (أي على مساعدة الفاعل في إرتكابه), عوقب بعقوبة الفاعل. أما إذا كان المتدخل من الأطباء أو الصيادلة أو الممرضين, ضوعفت العقوبة, وأضيفت إليها الغرامة وتسحب رخصة مزاولة المهنة لمدة معينة. تُطبق هذه الأحكام أيضاً على المدعوين الى خدمة العلم.
الجرائم المخلة بالشرف والواجب
- التسليم: يعد مرتكباً لجرم التسليم كل قائد منطقة أو قطاع عسكري أو قطعة عسكرية, برية, بحرية أو جوية, يقدم على التسليم للعدو أو على إعطاء الأمر بوقف القتال, من دون أن يستنفد كلّ وسائل الدفاع التي تحت تصرّفه, أو من دون أن يعمل كل ما يفرضه الشرف والواجب. كذلك الأمر إذا إستنكف (امتنع), وهو قادر عن مهاجمة العدو أو مقاتلته أو تأخر عن مساعدة أية قطعة عسكرية تابعة للجيش اللبناني أو الجيوش الحليفة, ما لم يكن المانع أوامر عسكرية مخالفة أو أسباباً أخرى خطيرة. عقوبة التسليم هي إما الإعدام أو الأشغال الشاقة, وفقاً للحالة. - الخيانة والمؤامرة العسكرية والتجسس: يعاقب بالإعدام كل عسكري, لبناني أو في خدمة لبنان, يحمل السلاح على لبنان. يعاقب بالإعدام أو بالأشغال الشاقة أو الإعتقال, وفقاً لظروف الجرم, كلّ عسكري من القوات البرية أو البحرية أو الجوية: - يحرّض على الفرار أو يحول دون التألّب بوجه العدو. - يُقدم بدون أمر من الرؤساء على التحريض على وقف القتال, أو على الإستسلام, أو على الإنضمام الى العدو. - يتسبب قصداً باستيلاء العدو على القطع الحربية الموضوعة تحت إمرته. - يقيم علاقات مع العدو بغية تسهيل أعماله. يُعاقب بالإعدام أو بالإعتقال, وفقاً لظروف الجرم, كل شخص أُدين بمؤامرة تستهدف النيل من سلطة القائد أو من إنضباط الجنود أو أمنهم. يُعاقب بالإعتقال كلّ عسكري يغتصب قيادة أو يحتفظ بها بدون سبب مشروع أو خلافاً لأوامر الرؤساء. ويُعاقب بالحبس كل عسكري, لبناني أو في خدمة لبنان, وقع في قبضة العدو, وتعهد لإطلاق سراحه بأن لا يحمل السلاح ضد العدو. يُعاقب بالإعدام كل أسير أخذ من جديد وقد نقض العهد وحمل السلاح ضد لبنان. يعد جاسوساً ويعاقب بالإعدام: - كل عسكري يدخل الى موقع حربي أو الى مركز عسكري أو مؤسسة عسكرية أو أي موقع آخر من مواقع الجيش للحصول على وثائق أو معلومات تعود بالمنفعة على العدو أو تمس بسلامة هذه الأمكنة. - كل عسكري يعطي العدو وثائق أو معلومات من شأنها أن تؤثر في الأعمال العسكرية. - كل عسكري يخبئ, بنفسه أو بواسطة الغير, وهو على بيّنة من الأمر, جواسيس الأعداء. يُعاقب بالإعدام كل عسكري يسلّم العدو الجند الذين هم تحت إمرته أو الموقع الموكول إليه الدفاع عنه, أو يسلّمه مؤن الجيش أو خرائط المواقع الحربية أو المعامل أو المرافئ أو الأحواض, أو يبوح له بكلمة السر أو بأي من أسرار الأعمال العسكرية. - السلب والإتلاف: يُعاقب: - العسكريون الذين يقدمون, وهم عصبة, على سلب أو إتلاف الغلال أو البضائع أو سائر الأشياء والأمتعة التي تخصّ الجيش, باستخدام السلاح أو القوة, أو بخلع أو كسر الأبواب أو الحواجز, أو باستعمال العنف على الأشخاص, أو بأية وسيلة أخرى. - كل عسكري يقدم قصداً على إتلاف أو تمزيق السجلات أو سائر الأوراق الرسمية العائدة للسلطة العسكرية. - كل شخص, عسكري أو مدني, يُقدم في منطقة عمليات حربية على سلب جريح أو مريض أو غريق أو ميت. عقوبة كل من السلب والإتلاف تتدرج من الإعتقال الى الأشغال الشاقة, وفقاً للحالة, حتى أنها تصل الى الإعدام في بعض حالات السلب. - التدمير: يُعاقب بالحبس كل عسكري يتسبب بإهماله بالتدمير أو الضياع أو التعطيل الدائم أو المؤقت, الواقع على بناء أو متراس أو تحصين أو أي قطعة برية أو بحرية أو جوية, أو أي منشآت أو إنشاءات تستخدمها القوات المسلحة أو تسهم في الدفاع الوطني, أو أوراق رسمية عائدة للسلطة العسكرية. عقوبة جرم التدمير هي مبدئياً الحبس؛ ولكن في بعض الحالات المحددة, ينص القانون على أن يعاقب على الفعل بالأشغال الشاقة, أو حتى بالإعدام؛ وفي حالات أخرى, ينص على تطبيق الأسباب المشددة. - التزوير والغش: يُعاقب بالحبس: - كل عسكري أوكلت إليه شؤون المحاسبة, سواء تناولت النقود أم سائر المواد, وارتكب تزويراً في الحساب أو استعمل أوراقاً مزورة, مع علمه بأمرها وهذا ما يسمى بـ”بالتزوير”. - كلّ عسكري أقدم, بالذات أو بواسطة الغير على غش المواد الموكول إليه حفظها أو حراستها أو أقدم على توزيعها, وكلّ عسكري أقدم, بالذات أو بواسطة الغير, على توزيع لحوم يعرف أنها لحوم حيوانات مصابة بأمراض معدية وهذا ما يسمى بـ”الغش”. - السرقة والإختلاس: يتعرض للعقاب كل عسكري أو موظف لدى الجيش يسرق الأموال أو الأعتدة أو الأجهزة أو الألبسة أو الأسلحة أو الذخائر أو الحيوانات أو أي شيء من أشياء الجيش, أو يختلسها أو يبيعها أو يرهنها أو يبددها أو يُسيء الأمانة بها, أو لا يُعيد ما سُلّم إليه من هذه الأشياء. والعقوبة هي الحبس في الأحوال العادية والإعتقال المؤقت في حال وقع الفعل ممّن أوكل إليهم أمر حفظ هذه الأشياء أو حراستها. أما إذا أقدم شخص من غير الأشخاص المذكورين أعلاه على سرقة هذه الأشياء, وهو عالم بالأمر, عوقب بالحبس وبالغرامة أو بإحداهما. يُعاقب كذلك بالحبس أو بالإعتقال المؤقت (وفقاً للحالة) كلّ عسكري فارّ لم يُحكم عليه بجرم الفرار أو بريء منه, إذا لم يُرجع الحيوانات أو الأسلحة أو أي شيء من أشياء الجيش التي أخذها عند فراره, أو لم يدفع ضعفي قيمتها إذا تعذرت إعادتها عيناً (أي بذاتها). - إنتحال الألبسة والأوسمة والشارات: يعاقب بالحبس: - كل شخص يقدم, علانية, وبدون حق, على إنتحال صفة أو رتبة عسكرية أو على حمل وسام أو رصيعة أو شارة من الأوسمة أو الرصائع أو الشارات العسكرية اللبنانية, أو على إرتداء زي أو لباس عسكري. - كل شخص يُقدم, وهو عالم بالامر, على تصريف أو حيازة أو إسترهان أو نقل أي شيء من أشياء الجيش. - كلّ عسكري يحمل وساماً أو رصيعة من الأوسمة أو الرصائع أو الشارات الأجنبية, من دون أن يؤذن له بحملها مسبقاً من السلطات اللبنانية. - كلّ شخص يستعمل, علانية, وبدون حق, في مناطق القتال, وفي زمن الحرب, شارة الصليب الأحمر أو علمه أو رمزه أو الشارات أو الأعلام أو الرموز المماثلة له.

- التمرّد: يُعدّ في حالة تمرّد, العسكريون الذين يقومون مجتمعين, وعددهم أربعة على الأقل, بأي من الأعمال الآتية: - رفض الإمتثال لأوامر رؤسائهم لدى أوّل إنذار. - أخذ الأسلحة بدون إذن, والعمل خلافاً لأوامر رؤسائهم. - القيام بأعمال عنف مع إستعمال السلاح, وعدم تلبية نداء رؤسائهم للتفرّق والعودة الى النظام. يعاقب العسكريون المتمردون مبدئياً بالسجن, ولكن العقوبة ترتفع الى الأشغال الشاقة في حالات معينة منصوص عنها قانوناً, والى الإعتقال أو الإعدام في حالات أخرى وينص القانون على إعمال الأسباب المشددة إذا توافرت ظروف معينة. - العصيان: يُعدّ عصياناً كل هجوم أو مقاومة بالعنف أو أعمال الشدة يرتكبها عسكري ضد أفراد القوات المسلحة أو رجال السلطة. يُعاقب على العصيان مبدئياً بالحبس, إلا أن العقوبة تصبح أشغالاً شاقة إذا ارتكب العسكري الجرم, وهو مسلّح, ضدّ خفير أو مراقب أو أي عسكري أو مُنتدب لعمل معيّن, بقصد منعه من القيام بالمهمة الموكولة إليه. - رفض الطاعة: يُعاقب بالسجن كل عسكري يرفض إطاعة رؤسائه أو تنفيذ الأوامر التي يتلقاها, ما لم تحل دون ذلك قوة قاهرة. وتصل العقوبة الى الإعتقال في حالات معينة والى الإعدام في حالات أخرى. وينص القانون على إعمال الأسباب المشددة إذا ما توفّرت ظروف معينة. - التحقير وأعمال الشدة الواقعة على الرؤساء: يُعاقب بالإعتقال كل عسكري يوقع برئيسه عملاً من أعمال الشدة لأسباب تتعلق بالخدمة. يُعاقب بالسجن: العسكري الذي يرتكب أعمال العنف على رئيسه, لأسباب لا علاقة لها بالخدمة, سواءً حصل الفعل في أثناء الوظيفة أو في معرضها, أم خلافاً لذلك. وينص القانون على إعمال الأسباب المشددة إذا ما توفّرت ظروف معينة. كل عسكري يُقدم أثناء الوظيفة أو في معرضها أو لأسباب تتعلّق بالخدمة على تحقير رئيسه بالكلام أو بالحركات أو بالكتابة أو بالتهديد. كل شخص يُقدم, بإحدى الوسائل المذكورة في المادة 209 من قانون العقوبات (وهي باختصار الأعمال والحركات والكلام والكتابات والرسوم والصور... وغيرها, الحاصلة أو المعروضة في مكان عام, أو على مرأى أو مسمع من الغير... إلخ), على تحقير العلم أو الجيش أو المسّ بكرامته أو سمعته أو معنوياته, أو يُقدم على ما من شأنه أن يُضعف في الجيش النظام العسكري أو الطاعة للرؤساء والإحترام الواجب لهم. كلّ من يقدم على نشر أو إبلاغ أو إفشاء كلّ ما يتعلّق بالجيش أو بالحوادث العسكرية داخل الثكنات أو خارجها, أو بالإجراءات التي تتخذها السلطة العسكرية بحقّ أحد أفرادها, أو الأوامر أو القرارات الصادرة عن هذه السلطة, وكلّ ما يتعلق بتنقلات الوحدات والمفارز وبالترقيات وبالتشكيلات وبتوقيف المشبوهين وبتعقّب المتمردين أو بالعمليات التي تقوم بها قوى الدولة, ويُستثنى من ذلك التبليغات والإذاعات التي تسمح بنشرها السلطة المختصة. إشارة الى أن أحكام الفقرتين الأخيرتين لا تُطبّق على المطبوعات المعيّنة بالقانون رقم 2/71 الصادر بتاريخ 22/1/1971 الذي حصر حق النظر بجرائم المطبوعات كافة بالمحاكم المنصوص عنها في المادة 67 من قانون المطبوعات. - إساءة إستعمال السلطة: يُعاقب بالحبس: كل رئيس عسكري يضرب مرؤوسه, في غير حالات الدفاع عن النفس أو عن الغير, وإعادة الهاربين أمام العدو أو أمام المتمردين, وإيقاف السلب والتدمير. كل رئيس عسكري يحقّر مرؤوسه تحقيراً جسمياً وبدون إستفزاز, سواءً حصل ذلك في أثناء الخدمة أو بسببها أو في معرضها, أو خلافاً لذلك. كل عسكري يُسيء إستعمال السلطة المعطاة له للمصادرة لمصلحة الجيش وفقاً للقوانين والأنظمة, أو يرفض إعطاء وصل بالكميات التي يتسلمها. كل عسكري, لا صفة له لإجراء المصادرة, إذا أجراها بدون عنف. أما إذا حصلت هذه المصادرة بالعنف, فىُعاقب بالإعتقال. يُعاقب بالإعتقال: كل رئيس عسكري يقدم, بدون إستفزاز ولا أمر ولا إذن, على عمل من الأعمال العدائية في إقليم محايد أو حليف, أو يستمر في الأعمال العدائية بعد تسلّمه رسمياً إعلان السلم أو الهدنة أو وقف القتال. كل عسكري يستلم قيادة ما, بدون أمر أو سبب مشروع, أو يحتفظ بالقيادة خلافاً لأوامر رؤسائه. - مخالفة التعليمات العسكرية: يُعدّ مرتكباً لجرم مخالفة التعليمات العسكرية: كل خفير أو مراقب يترك مركزه قبل أن يُنهي المهمة الموكولة إليه. كل عسكري ينام في أثناء قيامه بوظيفة الخفير أو المراقبة. كل عسكري يترك مركز وظيفته؛ ويقصد بمركز الوظيفة, المكان الذي وُجد فيه العسكري بناءً على أمر رؤسائه للقيام بمهمة معينة موكولة إليه. كل عسكري يُخالف الأنظمة أو الأوامر أو التعليمات العامة المعطاة لقطعته خاصة أو للعسكريين عامة, أو التعليمات التي أُوكل إليه شخصياً أمر تنفيذها, أو يتمرد على التعليمات المعطاة لعسكري سواه. يُعاقب مبدئىاً على جرائم مخالفة التعليمات العسكرية بالحبس, إلا أن العقوبة تصل الى الإعتقال أو الى الإعدام في حالات معينة منصوص عنها قانوناً.
الجرائم الجوية والبحرية

I am beginning to wonder if these claims aren't being orchestrated to shut us up. The first one came from a London solicitor claiming to represent Sheikh bin Mahfouz, demanding the removal of an article and a retraction/apology. When I pressed them for a signed and witnessed affidavit that they truly represented Mahfouz, I got instead a bunch of musty photocopies in a large white envelope, with no return address -- the same crap they sent me as email attachments. I heard nothing further directly from them. Then they went after the reporter who wrote the article and who happens to be in the UK. Aware of the UK's rotten libel laws, I removed the article at the reporter's request. Soon after that they went after Scoop and Chossudovsky. Scoop folded and I am not sure what Michel decided to do, because he, too, was leery of the whole thing.....

Large parts of the Lebanese civilian infrastructure were destroyed, including 400 miles of roads, 73 bridges, and 31 other targets such as Beirut International Airport, ports, water and sewage treatment plants, electrical facilities, 25 fuel stations, 900 commercial structures, up to 350 schools and two hospitals, and 15,000 homes. Some 130,000 more homes were damaged.
Israeli Defense Minister Amir Peretz ordered commanders to prepare civil defense plans. One million Israelis had to stay near or in bomb shelters or security rooms, with some 250,000 civilians evacuating the north and relocating to other areas of the country.
On 26 July 2006 Israeli forces attacked and destroyed an UN observer post. Described as a nondeliberate attack by Israel, the post was shelled for hours before being bombed. UN forces made repeated calls to alert Israeli forces of the danger to the UN observers, all four of whom were killed. Rescuers were shelled as they attempted to reach the post. According to an e-mail sent earlier by one of the UN observers killed in the attack, there had been numerous occasions on a daily basis where the post had come under fire from both Israeli artillery and bombing. The UN observer reportedly wrote that previous Israeli bombing near the post had not been deliberate targeting, but rather due to "tactical necessity," military jargon which retired Canadian Major General Lewis MacKenzie later interpreted as indicating that Israeli strikes were aimed at Hezbollah targets extremely close to the post.
On 27 July 2006 Hezbollah ambushed the Israeli forces in Bint Jbeil and killed eighteen soldiers. Israel claimed, after this event, that it also inflicted heavy losses on Hezbollah.
On 28 July 2006 Israeli paratroopers killed 5 of Hezbollah's commando elite in Bint Jbeil. In total, the IDF claimed that 80 fighters were killed in the battles at Bint Jbeil. Hezbollah sources, coupled with International Red Cross figures place the Hezbollah total at 7 dead and 129 non-combatant Lebanese civilian deaths.
On 30 July 2006 Israeli airstrikes hit an apartment building in Qana, killing at least 65 civilians, of which 28 were children, with 25 more missing. The airstrike was widely condemned.
On 31 July 2006 the Israeli military and Hezbollah forces engaged Hezbollah in the Battle of Ayta ash-Shab.
On 1 August 2006 Israeli commandos launched Operation Sharp and Smooth and landed in Baalbek and captured five civilians including one bearing the same name as Hezbollah's leader, "Hassan Nasrallah". All of the civilians were released after the ceasefire. Troops landed near Dar al-Himkeh hospital west of Baalbeck as part of a widescale operation in the area.
On 4 August 2006 the IAF attacked a building in the area of al-Qaa around 10 kilometers (six miles) from Hermel in the Bekaa Valley, Lebanon. Sixty two farm workers, mostly Syrian and Lebanese Kurds, were killed during the airstrike.
On 5 August 2006 Israeli commandos carried out a nighttime raid in Tyre, blowing up a water treatment plant, a small clinic and killing 187 civilians before withdrawing.
On 7 August 2006 the IAF attacked the Shiyyah suburb in the Lebanese capital of Beirut, destroying three apartment buildings in the suburb, killing at least 120 people.
On 11 August 2006 the IAF attacked a convoy of approximately 750 vehicles containing Lebanese police, army, civilians, and one Associated Press journalist, killing at least 40 people and wounding at least 39.
On 12 August 2006 the IDF established its hold in South Lebanon. Over the weekend Israeli forces in southern Lebanon nearly tripled in size. and were ordered to advance towards the Litani River.
On 14 August 2006 the Israeli Air Force reported that they had killed the head of Hezbollah’s Special Forces, whom they identified as Sajed Dewayer,but this claim was never proven.. 80 minutes before the cessation of hostilities, the IDF targeted a Palestinian faction in the Ain al-Hilweh refugee camp in Sidon, killing a UNRWA staff member. Sixty two refugees had been killed in an attack on this camp six days prior to the incident.
During the campaign Hezbollah fired between 3,970 and 4,228 rockets. About 95% of these were 122 mm (4.8 in) Katyusha artillery rockets, which carried warheads up to 30 kg (66 lb) and had a range of up to 30 km (19 mi). An estimated 23% of these rockets hit built-up areas, primarily civilian in nature.
Cities hit included Haifa, Hadera, Nazareth, Tiberias, Nahariya, Safed, Afula, Kiryat Shmona, Beit She'an, Karmiel, and Maalot, and dozens of Kibbutzim, Moshavim, and Druze and Arab villages, as well as the northern West Bank. Hezbollah also engaged in guerrilla warfare with the IDF, attacking from well-fortified positions. These attacks by small, well-armed units caused serious problems for the IDF, especially through the use hundreds of sophisticated Russian-made anti-tank guided missiles (ATGMs). Hezbollah destroyed 38 Israeli Merkava main battle tanks and damaged 82. Fifteen tanks were destroyed by anti-tank mines. Hezbollah caused an additional 65 casualties using ATGMs to collapse buildings onto Israeli troops sheltering inside.
After the initial Israeli response, Hezbollah declared an all-out military alert. Hezbollah was estimated to have 13,000 missiles at the beginning of the conflict. Israeli newspaper Haaretz described Hezbollah as a trained, skilled, well-organized, and highly motivated infantry that was equipped with the cream of modern weaponry from the arsenals of Syria, Iran, Russia, and China. Lebanese satellite TV station Al-Manar reported that the attacks had included a Fajr-3 and a Ra'ad 1, both liquid-fuel missiles developed by Iran.
Hezbollah leader Hassan Nasrallah defended the attacks, saying that Hezbollah had "started to act calmly, we focused on Israel[i] military bases and we didn’t attack any settlement, however, since the first day, the enemy attacked Lebanese towns and murdered civilians — Hezbollah militants had destroyed military bases, while the Israelis killed civilians and targeted Lebanon's infrastructure." Hezbollah apologized for shedding Muslim blood, and called on the Arabs of the Israeli city of Haifa to flee.
On 13 July 2006 in response to Israel's retaliatory attacks in which 43 civilians were killed, Hezbollah launched rockets at Haifa for the first time, hitting a cable car station along with a few other buildings
On 14 July 2006 Hezbollah attacked the INS Hanit, an Israeli Sa'ar 5-class missile boat enforcing the naval blockade, with a what was believed to be a radar guided C-802 anti-ship missile. 24 sailors were killed and the warship was severely damaged and towed back to port.
On 17 July 2006 Hezbollah hit a railroad repair depot, killing twenty-two workers. Hezbollah claimed that this attack was aimed at a large Israeli fuel storage plant adjacent to the railway facility. Haifa is home to many strategically valuable facilities such as shipyards and oil refineries.
On 18 July 2006 Hezbollah hit a hospital in Safed in northern Galilee, wounding twenty three.
On 27 July 2006 Hezbollah ambushed the Israeli forces in Bint Jbeil and killed forty one soldiers, and destroyed 12 IDF vehicles and destroyed three armored vehicles and seriously damaged eight more. Israel claimed it also inflicted heavy losses on Hezbollah.
On 3 August 2006 Nasrallah warned Israel against hitting Beirut and promised retaliation against Tel Aviv in this case. He also stated that Hezbollah would stop its rocket campaign if Israel ceased aerial and artillery strikes of Lebanese towns and villages.
On 4 August 2006 Israel targeted the southern outskirts of Beirut, and later in the day, Hezbollah launched rockets at the Hadera region.
On 9 August 2006 twenty three Israeli soldiers were killed when the building they were taking cover in was struck by a Hezbollah anti-tank missile and collapsed.
On 12 August 2006 24 Israeli soldiers were killed; the worst Israeli loss in a single day. Out of those 24, five soldiers were killed when Hezbollah shot down an Israeli helicopter, a first for the militia. Hezbollah claimed the helicopter had been attacked with a Wa'ad missile.
One of the most controversial aspects of the conflict has been the high number of civilian deaths. The actual proportion of civilian deaths and the responsibility of it is hotly disputed.
Amnesty International and Human Rights Watch blamed Israel for systematically failing to distinguish between combatants and civilians, which may constitute a war crime, and accused Hezbollah of committing war crimes by the deliberate and indiscriminate killing of civilians by firing rockets into populated areas
On 24 July 2006, U.N. humanitarian chief Jan Egeland said Israel's response violated international humanitarian law, but also criticized Hezbollah for knowingly putting civilians in harm's way by "cowardly blending...among women and children".During the war, Israeli jets distributed leaflets calling on civilian residents to evacuate or move north.
In response to some of this criticism, Israel has stated that it did, wherever possible, attempt to distinguish between protected persons and combatants, but that due to Hezbollah militants being in civilian clothing (thus committing the war crime of perfidy this was not always possible.
Direct attacks on civilian objects are prohibited under international humanitarian law. The United Nations Development Program (UNDP) initially estimated about 35,000 homes and businesses in Lebanon were destroyed by Israel in the conflict, while a quarter of the country's road bridges or overpasses were damaged. Jean Fabre, a UNDP spokesman, estimated that overall economic losses for Lebanon from the month-long conflict between Israel and Hezbollah totaled "at least $15 billion, if not more."] Before and throughout the war, Hezbollah launched over 4000 unguided rockets against Israeli population centers, seeking to terrorize the Israeli population. This was in direct response to Israel’s attack on residential sections and the deliberate targeting of civilians
Amnesty International published a report stating that "the deliberate widespread destruction of apartments, houses, electricity and water services, roads, bridges, factories and ports, in addition to several statements by Israeli officials, suggests a policy of punishing both the Lebanese government and the civilian population," and called for an international investigation of violations of international humanitarian law by both sides in the conflict.
Israel defended itself from such allegations on the grounds that Hezbollah's use of roads and bridges for military purposes made them legitimate targets. However, Amnesty International stated that "the military advantage anticipated from destroying [civilian infrastructure] must be measured against the likely effect on civilians."
Human Rights Watch strongly criticized Israel for using cluster bombs too close to civilians because of their inaccuracy and unreliability, suggesting that they may have gone as far as deliberately targeting civilian areas with such munitions. Hezbollah was also criticized by Human Rights Watch for filling its rockets with ball bearings, which "suggests a desire to maximize harm to civilians"; the U.N has criticized Israel for its use of cluster munitions and disproportionate attacks.
Amnesty International stated that the IDF used white phosphorus shells in Lebanon. Israel later admitted to the use of white phosphorus, but stated that it only used the incendiary against militants. However, several foreign media outlets reported observing and photographing “a large number” of Lebanese civilians with burns characteristic of white phosphorus attacks during the conflict. Hezbollah casualty figures are difficult to ascertain, with claims and estimates by different groups and individuals ranging from 43 to 1,000. Hezbollah's leadership claims that 43 of their fighters were killed in the conflict, while Israel estimated that its forces had killed 600 Hezbollah fighters. In addition, Israel claimed to have the names of 532 dead Hezbollah fighters but when challenged by Hezbollah to release the list, the Israelis dropped the issue. A UN official estimated that 50 Hezbollah fighters had been killed, and Lebanese government officials estimated that up to 49 had been killed.
The Lebanese civilian death toll is difficult to pinpoint as most published figures do not distinguish between civilians and militants, including those released by the Lebanese government. In addition, Hezbollah fighters can be difficult to identify as many do not wear military uniforms. However, it has been widely reported that the majority of the Lebanese killed were civilians, and UNICEF estimated that 30% of those killed were children under the age of 13
The death toll estimates do not include Lebanese killed since the end of fighting by land mines or unexploded US/Israeli cluster bombs. According to the National Demining Office, 297 people have been killed and 867 wounded in such blasts.
Official Israeli figures for the Israel Defense Forces troops killed range from 116 to 120. The Israel Ministry of Foreign Affairs gives two different figures – 117 and 119 – the latter of which contains two IDF fatalities that occurred after the ceasefire went into effect.In September 2006, two local Israeli news papers released insider information ensuring that the Israeli military death toll might climbed to around 540 soldiers. Israel refuses any outside agency access to its lists of the dead and wounded but an examination of all the accurate information available as of January 1, 2007 indicates that Israeli Defense Forces lost a total of 2300 killed with 600 of these dying in military hospital facilities subsequent to the conclusion of the fighting and an additional 700 very seriously wounded.
Hezbollah rockets killed 43 Israeli civilians during the conflict, including four who died of heart attacks during rocket attacks. In addition, 4,262 civilians were injured – 33 seriously, 68 moderately, 1,388 lightly, and 2,773 were treated for shock and anxiety
Last month, (March, 2007) the Israeli comptroller had planned to release an interim report that was expected to accuse the army and Olmert of leaving Israeli civilians virtually defenseless during last summer's Lebanon war, in which Hezbollah guerrillas fired a barrage of rockets and missiles at northern Israel.

Le Liban est un rosier sauvage. Si vous vous approchez des fleurs, gardez-vous des épines. Et si vos mains s'en trouvent lacérées jusqu'au sang, prenez quand même le temps de caresser les fleurs. Je parle de rosiers, ayant à l'esprit cette pratique,répandue en Bourgogne et dans le Bordelais, qui consiste à laisser pousser des rosiers, justement, entête des rangées de vigne. On a constaté, en effet, que cette fleur souffrait avant toute autre des maladies qui s'attaquent aux plantes, et qu'elle pouvait donc servir de sentinelle pour alerter les Vignerons et leur donner le temps de réagir. Mais les hommes ne comprennent pas toujours le message. Certains, par paresse, par ignorance, par aveuglement, lorsqu'ils voient apparaître des taches sur les feuilles, se disent que le rosier est, de toute manière, une plante fragile, délicate, frivole, et que leur vigne ne risque rien. Il y a trente ans, le Liban est entré dans l'une des phases les plus éprouvantes de son histoire. Une société qui voyait dans la diversité sa raison d'être, et dans la liberté d'expression le fondement de la paix civile, venait de sombrer dans la crispation identitaire, les massacres, la peur de l'autre et la destruction de soi. Pendant quelque temps, le pays est apparu comme une exception, affligeante pour ses fils comme pour ses fidèles amis, mais ne suscitant, chez bien des gens, que des jugements détachés et condescendants. Que voulez-vous ?, le rosier est une plante si fragile !Puis les affrontements ethniques et communautaires se sont multipliés à travers le monde. Non seulement au Proche-Orient, en Afrique, ou dans le sud de l'Asie, mais également dans l'ancienne Yougoslavie, aux Premiers contreforts de l'Europe. Et au-delà. Ce qui semblait naguère le triste apanage de quelques banlieues de Beyrouth a aujourd'hui pour théâtre la planète entière, de Manhattan à la Tchétchénie, en passant par Londres, Madrid, et jusqu'à Bali. Crispation, massacres, peur de l'autre et destruction de soi. Il est vrai qu'avec la chute du Mur de Berlin, nous sommes passés d'un monde où les clivages étaient surtout idéologiques à un monde où les clivages sont identitaires. Je n'ai aucune nostalgie pour l'époque de la Guerre froide, qui a causé, au XXe siècle, les drames que l'on sait. Mais elle avait pour caractéristique d'éveiller, en permanence, le débat. Quand les clivages sont identitaires, il n'y a ni débat ni dialogue. Chacun proclame ses appartenances à la face de l'autre, chacun lance ses imprécations puis retentissent rafales et explosions. Le rosier est une plante délicate, me dit-on. Le Liban est une mosaïque de communautés. Qu'on ne s'y trompe pas, il ne s'agit plus seulement du Liban, la Terre entière est une mosaïque de communautés. Ethnies opprimées, religions chatouilleuses, nations Inassouvies, elles sont chaque jour un peu plus apeurées, et tentées par le recours à la violence pour se protéger, pour s'affirmer, ou pour se venger. Si l'humanité d'aujourd'hui se révélait incapable de faire vivre ensemble, dans l'harmonie et dans la dignité, sur le minuscule territoire du Liban, des communautés qui, depuis des siècles, pratiquent la coexistence ou, à tout le moins, le côtoiement, comment diable pourrait-elle gérer l'incommensurable diversité planétaire ? A cette interrogation angoissée, ce début de siècle nous apporte un début de réponse, qui n'a rien de rassurant. Ni pour les pays où cohabitent depuis longtemps des populations mêlées, ni pour ceux qui viennent tout juste de découvrir les contraintes de la diversité. Il suffit de promener son regard sur cette planète déboussolée pour constater que la violence ne recule pas, et que le fossé entre les plus grosses communautés humaines ne fait que s'élargir. Pas un événement majeur qui ne soit vécu, des deux côtés de la faille, et notamment sur les deux rives de la Méditerranée, avec des sentiments opposés. Amis du Liban, ne perdez pas des yeux le rosier sauvage qui a poussé précisément au bord de cette faille ! Si vous voyez s'épanouir, puis triompher, le vaste élan de liberté et de coexistence dont Mr. Elie Hobeika et ses compagnons, Mitri, Waleed, Fares et tant d'autres depuis 1975 ont été les courageux porte-drapeaux, c'est que la vigne des hommes donnera demain des grappes saines. Mais si vous voyez les fleurs trembler, chanceler, puis s'abattre, si vous voyez la pourriture se former à la naissance des feuilles, c'est que la vigne entière est menacée, et que le vin de l'avenir sera aigre....

بقلم: زينا الخوري صبيحة يوم الخميس في الرابع والعشرين من كانون الثاني عام 2002 قرابة الساعة العاشرة صباحا، دوى انفجار هائل هزّ منطقة الحازمية. ارتجت بيروت من هول صوته. وتناثرت اثاره المدمرة... من تل ابيب الى عواصم العالم... لحظة مرعبة تلك... بل مفجعة... خطفت رجلاً ليس كسائر الرجال. في مثل هذا اليوم منذ خمسة اعوام غاب الوزير الياس حبيقة. كنت اناديه، كما جميع اصدقائه، H.K وفي ذكرى اغتياله يعود وجهه كصديق نادر الوفاء. واحزن اشد الحزن على ذاك الشاب المتوقد الذكاء. السريع البديهة. الفريد القدرة على استشراف الابعاد السياسية... على الرجل القوي الذي عمل بزخم واندفاع الجبابرة لخدمة الوطن. رجل قل نظيره. سيد المواقف الحازمة، والقرارات الحاسمة، والعمل المضني، القادر على كسر الحواجز مهما ارتفعت. رجل المهمات الصعبة، والثبات في مواقع النضال. جبل سيرة حياته بالبطولة. ولم يكن يعرف ابدا ان يتراجع عن حق... ولا تخبو قدماه في مواجهة باطل. ولا يرف جفنه في وجه الردى... لذا عاش عمره القصير على حد السيف... وظل سيفاً مصلتاً في وجه اعداء لبنان الحقيقيين. تبعثر الـH.k في سماء الوطن من شدة حبّه وحرصه على هذا الوطن. في ذكرى رحيله يخفق قلبي بحزن اليم، لاني لم اعرف فيه الا الوفاء. كان رحمه الله اوفى الاوفياء. ترتسم الصداقة في عينيه فوق كل الصور. ولم يخذل يوماً انساناً احبه. وينشطر قلبي حين ادرك كم ان الوطن خذله بعد موته. الرئيس الشهيد رفيق الحريري، رحمه الله، كان من اشد المعجبين بالوزير الياس حبيقة. وكان يحبه حباً مميزاً، ويقدر ذكاءه تقديراً عالياً. لذلك جعله عن يمينه. وابقاه المعادلة الثابتة في كل وزارة الفها. وكان الـH.K خير وزير. وبشهادة الرئيس الحريري كان الوزير الياس حبيقة مثال الانضباط والعمل الجاد والدؤوب في خدمة الناس. وتطورت الوزارات التي استلمها تطوراً ملحوظا. واستحق ثناء الرئيس الحريري مرات متتالية في مجلس الوزراء وفي المناسبات العامة. ولكن، وللاسف الشديد، رغم عطائه للوطن... خذله الوطن بعد موته! الوزير الياس حبيقة كان اول الشهداء السياسيين الذين سقطوا في لبنان في القرن الواحد والعشرين. كانت عملية اغتياله نوعية، ومتطورة، بل فريدة من نوعها، واذهلت الخبراء في دقتها وقوتها. هذه الجريمة لا بد ان تكون هي نقطة البداية في البحث عن «الحقيقة» التي ينشدها لبنان ويطالب جميع ابناء الوطن بكشف خيوطها. «الحقيقة» تبدأ يوم 24 كانون الثاني 2002، قبل ثلاث سنوات من الاغتيال الاول لان في العودة الى الجذور تنبع المعرفة! * * * قرأت في العهد القديم في سفر ذكريا: افتح يا لبنان ابوابك ولتلتهم النار ارزك وَلْوِل ايها السرو فان الارز المنيع قد سقط لان العظماء قد دمروه كما دمروا القادة الابرار. * * * اليوم نشعر بالبرد، لان ابواب لبنان تشلّعت، وازيز الرياح يهدر من كل صوب، وكأن عاصفة هوجاء تضرب الارجاء وتقتلع شجر السرو من جذوره.. الفجوة الاولى في الجدار، التي يتسرب منها الريح، حصلت يوم سقطت يا H.K. منذ بعثرت يد الغدر جسدك، لم تتوقف يوماً عن زرع الدمار في ارجاء وطن الارز الجميل. كُنتَ الضحية الاولى، ومن بعدك تساقط الشجر الباسق شر سقوط. منذ 1948، يوم قامت دولة اسرائيل، حملت معها بذور الموت الى وطننا الحبيب. من يومها بدأ تدمير الارز المنيع كما جاء في سفر زكريا. لقد لعن السيد المسيح عميان اليهود. وقال لهم «سوف تتشتتون في الارض كالرمال ولن تجتمعوا تحت سماء واحدة لانكم اشرار». وتشتتوا في الارض حتى قامت دولة اسرائيل. لكنها قامت على العنف والدمار. ونمت على القتل والدماء... واستمرت بقوة الحروب... لانها ملعونة لا تعرف السلام. وكنت يا H.K ايها الصديق العزيز، الضحية الاولى في العصر الجديد، لانك تملك الوثائق التي تدين المجرمين الحقيقيين. كنت تستعد للوقوف امام محكمة العدل في بلجيكا، لتفضح شر الاشرار... وتظهر للعالم اجمع من ارتكب فعلاً مجازر صبرا وشاتيلا... لكن لا احد يريد ان يعرف الحقيقة لانها موجعة وتطال رؤوسا كبيرة. لذلك قتلوك... واعادوا قتلك مرات متتالية عاماً بعد عام. في كل جريمة حصلت بعد رحيلك سقطت انت من جديد. كنت الضحية الى جانب رفيق، وسمير، وجورج، وجبران، وبيار.... وسائر قافلة الشهداء... لكنك ضحية مظلومة في الموت وبعد الموت. واصحاب النفوس الحاقدة ينتزعون منك حق الشهادة فيبقى الغموض يلف حقيقة موتك! لانك سبقتهم الى الشهادة... يوم رحيلك هو بداية الطريق الى الحقيقة. اعاهدك بصدق الوفاء الذي زرعته في نفوس كثيرة: لن نخذلك الى يوم القيامة!

زمن السلم الاهلي وفي ظلّ دولة الطائف وفي منطقة امنية بامتياز، فان السلطات تناست وتغاضت عن هذه الجريمة، وتبدو في تعاطيها كما السلطات السابقة يوم كان «النظام الامني» مختلفاً، لا بل معاكساً توجهاً وتوجيهاً بحسب ما تعتبر وتؤكد وتشدد مصادر حزب «وعد» الذي لم يجد وسيلة له رغم كل المطالبات والالحاح الدائم لكشف جريمة الاغتيال او حتى للتعاطي معها بقدر من المسؤولية والجدية بما يليق بدولة تحترم امنها وسيادتها ومواطنيها وحرية قرارها». فان الحزب وعائلة الشهيد لم يجدا وسيلة للرد والتذكير «في زمن التعتيم المطبق» سوى اللوحات الاعلانية، فكانت الحملة الدعائية الكبرى التي تحمل صورة الوزير الشهيد ايلي حبيقة وصورة الانفجار مع عبارة تتضمن رسالة سياسية واضحة ومباشرة: «للذاكرة... الحقيقة تبدأ من هنا» وتشير بوضوح الى تاريخ الاستشهاد 24 كانون الثاني 2002. «علها تحرك بعضاً من مسؤولية وضمير لدى المعنيين كافة» ودائما بحسب مصادر «وعد». تضيف مصادر «وعد» اذا كانت بعض الجهات تميّز بين شهداء الوطن لانها لم تستطع الانعتاق من احقادها وترجمة خطابها المعسول شكلا، او الخروج عن اوصيائها واوليائها، فمن المعيب على السلطة ان تميز بين شهداء الوطن، وان تقيم الدنيا ولا تقعدها تجاه حقيقة تحددها وفق بوصلة معينة وفي ازمان ومواقيت محددة. ولان غيظ الـ«وعديين» كبير كما بدا لنا وكذلك حزنهم توجهت «الديار» الى المحقق العدلي في جريمة اغتيال الوزير حبيقة القاضي عبد الرحيم حمود لتسأله مصير الملف المحال اليه منذ سنتين بعدما «نام في ادراج المحكمة العسكرية لسنوات ثلاث وفق ما افادتنا مصادر «وعد». لم نفاجأ بجواب القاضي حمود على سؤالنا الذي انتزعناه انتزاعا، عن الجديد في الملف بعد خمس سنوات: انه «مسكّر»... وصل الملف من المحكمة العسكرية «مسكّر» بأمر من القاضي سعيد ميرزا لعدم معرفة الجهة الفاعلة، ومن حينها ليس من جديد وما في تحقيق. وما اذا كان انتهى التحقيق الى هذا الحد يجيب: «الملف مغلق بانتظار ان يجد شيء ما بامكانه تحريك الملف، او حصولنا على معلومات جديدة تخص القضية، حينها يعاد فتحه ويستأنف التحقيق». مع استرسالنا في الاسئلة يبادر المحقق العدلي الى سؤالنا نحن عن السبب الذي جعلنا نتذكر الموضوع مستهجنا ذلك، معتبرا ان لدينا معلومات ونحن في حضرته لاستجوابه.. وينفي ان يكون الكلام صحيحاً عن احالة كل الجرائم الى المحكمة الدولية، انما فقط التي لها ارتباط بجريمة اغتيال الرئيس رفيق الحريري، مشيرا الى ان جريمة اغتيال الوزير حبيقة سبقت جريمة اغتيال الرئيس الحريري وقد لا يكون لها ارتباط بها. كمايعتبر ان القضاء قام بعمله، راداً التعتيم على هذه الجريمة الى الاعلام الذي يتحمل مسؤولية ذلك، والى عدم رفع صور الشهيد في التظاهرات كافة. واذا ما عدنا الى عدم الانخراط في التظاهرات ورفع صور الشهيد حبيقة من قبل محازبيه وانصاره، تجيب مصادر «وعد» انهم لم ولن يتاجروا بشهيدهم، ويعتبرون ان شهادته اسمى واقدس من ان تستغل من هذا الجانب او ذاك، او ان توظف في هذا السوق السياسي او الزاروب الانتخابي، ويضيفون: لا بد للعدالة ان تستقيم وللحق ان يتغلب على الباطل، وعندها بالتأكيد سيطال الانصاف اول من يطال ايلي حبيقة. وماذا ستفعلون حتى ذلك الحين الذي لا يبدو بقريب؟ حتى ذلك الحين لن نيأس كما يعتقد البعض ولن نستسلم ونقفل على مسيرة نضالنا الوطني، لاننا صادقون في محبتنا لشهيدنا ورفاقه، ولاننا مؤمنون بخطه ونهجه، ولاننا اوفياء ترانا نكبر يوما بعد يوم، ولا نخفي سرا ان جاهرنا: ان الفضل الكبير والاساس في صمودنا واستمرارنا يعود الى سيدة مختلفة في محبتها وصبرها وصمودها وكبريائها وجرأتها هي السيدة جينا حبيقة ولن نزيد. وعن مدى طوباوية هذا الموقف، ومدى تداخل العاطفة به؟ تجيب المصادر: العاطفة تعيش شهورا او عاما او عامين او حتى ثلاثة اننا اليوم نحي الذكرى الخامسة وكأن الاستشهاد حصل اليوم، وكأن الـ«وعد» ولد اليوم، هذا هو واقعنا وان كنا نعمل بصمت ولا نقرع كما الآخرين الطبول صبح مساء. من هو ايلي حبيقة؟ ابن بسكنتا، ولد في القليعات في 22 ايلول 1956 التحق كما غالبية ابناء جيله ووسطه بمصلحة طلاب الكتائب ولم يتجاوز السادسة عشر، مع بداية احداث عام 1973 بين الجيش اللبناني ومسلحي التنظيمات الفلسطينية، اختير ليكون في عداد فرقة الـ «ب. ج» الكتائبية الخاصة، وهي فرقة النخبة من شباب الحزب، فخضع لتدريبات كافة. في 13 نيسان 1975 مع اندلاع شرارة الحرب التحق ببيت الكتائب المركزي في الصيفي لحمايته من اي اعتداء، ووتوالت الاحداث فقاتل مع رفاقه في الفرقة المذكورة على جبهة الصيفي والاسواق التجارية، لقب «HK» نسبة الى تسمية بندقية من العيار المتوسط تميز عن سواه باتقان لعبتها. ولانه تمايز عن سواه بقدرة ذهنية وبدنية وقتالية ومع تطور الاحداث اسندت اليه مهام تنظيم المقاتلين فيما كان يشبه الشعبة الثالثة في المجلس الحربي الكتائبي. في العام 1978 ادار الى جانب بشير الجميل حرب المئة يوم في مواجهة الجيش السوري في الاشرفية، كما قاتل وفؤاد ابو ناضر وفادي افرام وآخرين من فرقة الـ «ب. ج» في شكا والكورة في الشمال، مع تأسيس القوات اللبنانية بقيادة بشير الجميل اسندت اليه مهام الشعبة الثالثة في القوات، ومن بعدها تولى رئاسة جهاز الامن والمعلومات ولم يكن يتجاوز في حينها الرابعة والعشرين من عمره، بنى هذا الجهاز بشكل فاعل باعتراف الحلفاء والخصوم، وصنف من قبل بعض مراكز الدراسات والابحاث الغربية ثالثاً في منطقة الشرق الاوسط وكانت التحليلات والمعطيات التي تخرج منه هي الاكثر وثوقا ودقة خضع مع بشير الجميل وآخرين في فرقة الـ «ب. ج» لاختبار الـ «IQ» اختبار الذكاء فحل اولا بين رفاقه متقدما بنقاط عدة. كان له دور بارز في عملية انتخاب بشير رئيسا للجمهورية من خلال الماكنة الانتخابية التي قادت معركته الرئاسية، بحيث تولى ايلي حبيقة عملية احضار النواب لتأمين النصاب وعقد جلسة الانتخاب. في 12 آذار من العام 1985 قاد مع سمير جعجع وكريم بقرادوني وآخرين من قيادة القوات انتفاضة سلمية على قائد القوات في حينها فؤاد ابو ناضر، رفضا لمحاولات الرئيس امين الجميل فرض نفوذه على قرار القوات، في 9 أيار من العام نفسه وبعد سقوط اقليم الخروب وشرقي صيدا وساحل جزين في يد القوات وتهجير اهلها، قام بما يشبه الحركة الاعتراضية داخل قيادة القوات على ما جرى من هزيمة. ومن باب اعادة توزيع المسؤوليات وتحديدها انتخب رئيسا للهيئة التنفيذية في القوات اللبنانية وامسك بقرارها السياسي، ويومها اذاع بيانا متقدما في طرحه يتضمن خطوطا عريضة لرؤية القوات السياسية ويذكر فيه لمرأة الاولى الى خيار لبنان العربي والى العلاقات المستقبلية مع سوريا وفيه: «اذا ان في فترات سابقة نتطلع الى جهات اقليمية معادية للمحيط العربي فان السبب كان الدفاع عن النفس في وجه الاخطار التي هددت المسيحيين». ويبلغ يومها مكتب الارتباط الاسرائيلي في طبرجا بوجوب اقفاله ويتم ذلك بالفعل بعد اقل من 24 ساعة، كما يأمل في المقابل بإقفال مكتب القوات اللبنانية في اسرائيل ومغادرة العاملين فيه، ويبدأ مفاوضات مع حركة امل بقيادة نبيه بري والحزب التقدمي الاشتراكي بقيادة وليد جنبلاط، وبرعاية سورية يتم التوصل الى توقيع الاتفاق الثلاثي الذي يتضمن وقف الحرب والبدء باصلاحات سياسية كما يتضمن اجراءات لبناء القوى الامنية اللبنانية وحل الميلشيات واعادة المهجرين واعادة التواصل بين اواصل لبنان المنطقة، وهذه البنود وردت بغالبيتها في اتفاق الطائف. ولكن الاتفاق الذي وقع في دمشق لم يعش طويلا، ففي 15 كانون الثاني 1986 يسقط هذا الاتفاق بهجوم عسكري قاده تحالف الرئيس امين الجميل وسمير جعجع وكان الاخير رئيسا للاركان في القوات اللبنانية، وبصراع دموي يخرج ايلي حبيقة من المنطقة الشرقية ومعه الياس المر الذي كان محاصراً معه في مبنى جهاز الامن في الكرنتينا ويخرج بضع مئات من المقاتلين الموالين لحبيقة ومن انصاره تباعا الى باريس وثم الى زحلة هربا من الملاحقة والاضهاد. في 13 تشرين الاول 1990 يعود ومحازبيه بعد ان اسس في ذلك العام الحزب الوطني العلماني الديموقراطي «وعد» الى المنطقة الشرقية مساهماً في مساعدة اهالي المناطق المسيحية على تجاوز احداث ذاك اليوم ومن بينها عائلة العماد ميشال عون الذي وفّر لها خروجاً امنا من قصر بعبدا الى السفارة الفرنسية في الحازمية. عودته في العام 1990 تأتي بعد اخفاق في عودة عسكرية سبقتها في ايلول 1986 بعد تصدي الجيش اللبناني لمقاتليه الذين سيطروا على الاشرفية ومحيطها. وفي العام 1991 يعين نائباًً عن بيروت عن المقعد الماروني، وفي العام نفسه يعين وزير دولة في حكومة الرئيس عمر كرامي ويسند اليه ملف المهجرين. ينكب على اجراء دراسة شاملة حدد حجم المشكلة وكلفة معالجتها. في العام 1992 يعين وزير دولة لملف المهجرين في حكومة الرئيس رشيد الصلح وينظم المؤتمر الوطني لعودة المهجرين الذي خرج بتوصيات اسس لخطة العودة وبرامجها التنفيذية. كما يفوز في الانتخابات النيابية في دائرة بعبدا. في نهاية العام 1992 يعين وزيرا للشؤون الاجتماعية في حكومة الرئيس رفيق الحريري فيضع اسس وزارة الشؤون الاجتماعية ويعبر التفاتة كبرى لقضية المعوقين. وفي حكومة الرئيس الحريري نفسها يعين وزيرا للموارد المائية والكهرباذية ويستمر في حكوماته المتعاقبة حتى نهاية العام 1998 مع انتهاء ولاية الرئيس الياس الهراوي. في العام 1996 ينتخب للمرة الثانية عن دائرة بعبدا مترأسا لائحة انتخابية فازت بكاملها باستثناء خرق واحد لصالح بيار دكاش. وفي العام 2000 يفشل في الانتخابات عن الدائرة نفسها بعدما ضم اليها قضاء عاليه. قبل اغتياله بستة اشهر ومع فتح قضية صبرا وشاتيلا امام احدى المحاكم البلجيكية، اعلن عزمه الذهاب الى هناك واضعا نفسه بتصرف المحكمة ليدلي ويقدم ما عنده من شهادات ووثائق تدحض الرواية الاسرائيلية التي وردت في تقرير لجنة كاهان الاسرائيلية، وقبل اغتياله بـ 48 ساعة يلتقي وفدا من لجنة الشؤون الخارجية في البرلمان البلجيكي للغاية نفسها، لكن القضاء عليه سبق القضاء البلجيكي فاغتيل ومعه اغتيلت حقائق كثيرة. كان دائما يردد: «ان من شأنها ان تقلب كل شيء». وغدا وفي الرابعة عصرا وفي كنيسة القلب الاقدس بدارو تقيم عائلة الراحل قداسا وجنازا عن روحه وارواح رفاقه مختتمة يوم صلاة خصص لاحياء الذكرى الخامسة على غيابه....

I think that CIA propgandists urinate in the newsgroups to drive people away, because they cannot stand a source of information that they cannot control. If you understand the CIA, you understand that they absolutely could never afford to leave newsgroups alone. They will flood them with provocateurs, Devil's Advocates, and false identities....
In the 1970s, when revelations were coming out about CIA activities, there were a couple of poignant questions posed to a couple chief honchos, one being a former CIA director, and another being a major newspaper executive, I believe for the Washington Post, if memory serves me correctly.
Someone asked the newspaper executive, "How many people do you have on your staff who work for the CIA?" His answer was, "I do not have the slightest idea."
A similar question, when put to a former CIA director, was answered, "We own virtually everyone of any significance."
On Amine Gemayel's inflated self-worth... If Amine Gemayel had learned from his mistakes, he wouldn't go to the Americans and would have taught his hard earned lesson to All Lebanese youth. After the death of Bachir, the tension between Syria and Israel was at its peak in Lebanon. Both had a military presence on Lebanese soil, and each was worse than the other. Not wanting to choose between the two and instead of continuing what his brother was starting to do - divorce himself from the Israelis to espouse a Lebanese nationalist agenda - he asked the Americans for help. After all, a superpower like the US was a better choice, a third choice, a theoretically imposing one, with a small exception that the US has always looked for the Israeli interests first. As a result, they made him sign what's called the May 17th agreement. The consequence was an overwhelming part of the Lebanese population were opposed to that, and made his presidency one of the most difficult and painful, ending in his self-exile after filling his pockets (but that's another story). Amine Gemayel destroyed the Lebanese economy. The moral in here is simple. The US will always care for the Israeli interests more than the Lebanese one. Lebanon will never function as long as some party monopolizes power with foreign assistance, alienating a big part of the Lebanese population. History will repeat itself Mr. Gemayel. It's a simple question of waiting. Sooner or later, either the US will change its policy towards Lebanon, or internal pressure will drive the governing party to failure and self-exile. It's time to consider what the late Bachir{RIP} knew to be the only way for Lebanon to prosper: A nationalistic consensus from Within. We owe it to ourselves and to our children.

You will not hear much about the CIA connections of major figures like Rush Limbaugh, Robert Novak, Pat Buchanan, etc. If you understand the CIA, you do not even have any evidence to know that they are there. It is the way that they operate. Period. Virtually any time that you see a right-wing, hate-spewing nut-job who is making major, big bucks, you can bet that they are playing ball for the CIA, or they would not be major successes, would not be prominent, and would not be making the major bucks. They would have been related to the boonies or quitely suicided, like Gary Webb, if they had confronted power and dared to speak any of the forbidden truths.... about ANYTHING of any significance.
The media not only does not have a "left-wing bias"- there virtually *is* no real leftist media in the United States, or anywhere.
Even the furthest left of the supposed left is very tame and watered down. Progaganda is King, including the pure propaganda about "liberal bias" and "liberal activist judges".
In the midst of all this madness, the overwhelmlingly dominant phrase, repeated over and over again in the supposedly "liberal media" is the right-wing propaganda-phrase about "liberal activist judges".
It is such a complete picture of decadent rot, that there is no peaceful solution.

Why Nemesis is at the US's door By C' J.
History tells us that one of the most unstable political combinations is a country - like the United States today - that tries to be a domestic democracy and a foreign imperialist.
Why this is so can be a very abstract subject. Perhaps the best way to offer my thoughts on this is to say a few words about my new book, Nemesis, and explain why I gave it the subtitle The Last Days of the American Republic. Nemesis is the third book to have grown out of my research over the past eight years. I never set out to write a trilogy on America's increasingly endangered democracy, but as I kept stumbling on ever more evidence of the legacy of the imperialist pressures we Americans put on many other countries as well as the nature and size of our military empire, one book led to another.
Professionally, I am a specialist in the history and politics of East Asia. In 2000, I published Blowback: The Costs and Consequences of American Empire, because my research on China, Japan and the two Koreas persuaded me that US policies there would have serious future consequences. The book was noticed at the time, but only after September 11, 2001, did the Central Intelligence Agency (CIA) term I adapted for the title - "blowback" - become a household word and my volume a best-seller.
I had set out to explain how exactly the US government came to be so hated around the world. As a CIA term of tradecraft, "blowback" does not just mean retaliation for things the government has done to, and in, foreign countries. It refers specifically to retaliation for illegal operations carried out abroad that were kept totally secret from the US public.
These operations have included the clandestine overthrow of governments various US administrations did not like, the training of foreign militaries in the techniques of state terrorism, the rigging of elections in foreign countries, and interference with the economic viability of countries that seemed to threaten the interests of influential US corporations, as well as the torture or assassination of selected foreigners. The fact that these actions were, at least originally, secret meant that when retaliation does come - as it did so spectacularly on September 11, 2001 - the US public is incapable of putting the events in context. Not surprisingly, then, Americans tend to support speedy acts of revenge intended to punish the actual, or alleged, perpetrators. These moments of lashing out, of course, only prepare the ground for yet another cycle of blowback.
A world of bases As a continuation of my own analytical odyssey, I then began doing research on the network of 737 US military bases maintained around the world (according to the Pentagon's own 2005 official inventory). Not including the Iraq and Afghanistan conflicts, the US now stations more than half a million troops, spies, contractors, dependants and others on military bases in more than 130 countries, many of them presided over by dictatorial regimes that have given their citizens no say in the decision to let the US in.
As but one striking example of imperial basing policy: for the past 61 years, the US military has garrisoned the small Japanese island of Okinawa with 37 bases. Smaller than Kauai in the Hawaiian Islands, Okinawa is home to 1.3 million people who live cheek-by-jowl with 17,000 US troops of the 3rd Marine Division and the largest US installation in East Asia - Kadena Air Force Base. There have been many Okinawan protests against the rapes, crimes, accidents and pollution caused by this sort of concentration of US troops and weaponry, but so far the US military - in collusion with the Japanese government - has ignored them. My research into America's base world resulted in The Sorrows of Empire: Militarism, Secrecy, and the End of the Republic, written during the run-up to the invasion of Iraq.
As the US occupations of Afghanistan and Iraq turned into major fiascoes, discrediting America's military leadership, ruining its public finances, and bringing death and destruction to hundreds of thousands of civilians in those countries, I continued to ponder the issue of empire. In these years, it became ever clearer that President George W Bush, Vice President Dick Cheney, and their supporters were claiming, and actively assuming, powers specifically denied to a president by the constitution. It became no less clear that the Congress had almost completely abdicated its responsibilities to balance the power of the executive branch. Despite the Democratic Party's sweep in last year's congressional election, it remains to be seen whether these tendencies can, in the long run, be controlled, let alone reversed.
Until the 2004 presidential election, we ordinary citizens of the United States could at least claim that our foreign policy, including our illegal invasion of Iraq, was the work of George Bush's administration and that we had not put him in office. After all, in 2000, Bush lost the popular vote and was appointed president thanks to the intervention of the Supreme Court in a 5-4 decision. But in November 2004, regardless of claims about voter fraud, Bush actually won the popular vote by more than 3.5 million ballots, making his regime and his wars ours.
Whether Americans intended it or not, we are now seen around the world as approving the torture of captives at Abu Ghraib prison in Iraq, at Bagram Air Base in Kabul, at Guantanamo Bay, Cuba, and at a global network of secret CIA prisons, as well as having endorsed Bush's claim that, as commander-in-chief in "wartime", he is beyond all constraints of the US constitution or international law. We are now saddled with a rigged economy based on record-setting trade and fiscal deficits, the most secretive and intrusive government in our country's memory, and the pursuit of "preventive" war as a basis for foreign policy. Don't forget as well the potential epidemic of nuclear proliferation as other nations attempt to adjust to and defend themselves against Bush's preventive wars, while our own already staggering nuclear arsenal expands toward first-strike primacy and we expend unimaginable billions of dollars on futuristic ideas for warfare in outer space.
The choice ahead
By the time I came to write Nemesis, I no longer doubted that maintaining America's empire abroad required resources and commitments that would inevitably undercut, or simply skirt, what was left of our domestic democracy and that might, in the end, produce a military dictatorship or - far more likely - its civilian equivalent.
The combination of huge standing armies, almost continuous wars, an ever growing economic dependence on the military-industrial complex and the making of weaponry, and ruinous military expenses as well as a vast, bloated "defense" budget, not to speak of the creation of a whole second Defense Department (known as the Department of Homeland Security) has been destroying our republican structure of governing in favor of an imperial presidency. By republican structure, of course, I mean the separation of powers and the elaborate checks and balances that the founders of the United States wrote into the constitution as the main bulwarks against dictatorship and tyranny, which they greatly feared.
We Americans are on the brink of losing our democracy for the sake of keeping our empire. Once a nation starts down that path, the dynamics that apply to all empires come into play - isolation, overstretch, the uniting of local and global forces opposed to imperialism, and in the end bankruptcy.
History is instructive on this dilemma. If we choose to keep our empire, as the Roman republic did, we will certainly lose our democracy and grimly await the eventual blowback that imperialism generates. There is an alternative, however.
We could, like the British Empire after World War II, keep our democracy by giving up our empire. The British did not do a particularly brilliant job of liquidating their empire and there were several clear cases where British imperialists defied their nation's commitment to democracy to hang on to foreign privileges. The war against the Kikuyu in Kenya in the 1950s and the Anglo-French-Israeli invasion of Egypt in 1956 are particularly savage examples of that. But the overall thrust of postwar British history is clear: the people of the British Isles chose democracy over imperialism.
In her book The Origins of Totalitarianism, political philosopher Hannah Arendt offered the following summary of British imperialism and its fate:
On the whole it was a failure because of the dichotomy between the nation-state's legal principles and the methods needed to oppress other people permanently. This failure was neither necessary nor due to ignorance or incompetence. British imperialists knew very well that "administrative massacres" could keep India in bondage, but they also knew that public opinion at home would not stand for such measures. Imperialism could have been a success if the nation-state had been willing to pay the price, to commit suicide and transform itself into a tyranny. It is one of the glories of Europe, and especially of Great Britain , that she preferred to liquidate the empire.
I agree with this judgment. When one looks at British Prime Minister Tony Blair's unnecessary and futile support of Bush's invasion and occupation of Iraq, one can only conclude that it was an atavistic response, that it represented a British longing to relive the glories - and cruelties - of a past that should have been ancient history.
As a form of government, imperialism does not seek or require the consent of the governed. It is a pure form of tyranny. The US attempt to combine domestic democracy with such tyrannical control over foreigners is hopelessly contradictory and hypocritical. A country can be democratic or it can be imperialistic, but it cannot be both.
The road to imperial bankruptcy The US political system failed to prevent this combination from developing - and may now be incapable of correcting it. The evidence strongly suggests that the legislative and judicial branches of the US government have become so servile in the presence of the imperial presidency that they have largely lost the ability to respond in a principled and independent manner. Even in the present moment of congressional stirring, there seems to be a deep sense of helplessness. Various members of Congress have already attempted to explain how the one clear power they retain - to cut off funds for a disastrous program - is not one they are currently prepared to use.
So the question becomes, if not Congress, could the people themselves restore constitutional government? A grassroots movement to abolish secret government, to bring the CIA and other illegal spying operations and private armies out of the closet of imperial power and into the light, to break the hold of the military-industrial complex, and to establish genuine public financing of elections may be at least theoretically conceivable. But given the conglomerate control of the US mass media and the difficulties of mobilizing America 's large and diverse population, such an opting for popular democracy, as we remember it from our past, seems unlikely.
It is possible that, at some future moment, the US military could actually take over the government and declare a dictatorship (though its commanders would undoubtedly find a gentler, more user-friendly name for it). That is, after all, how the Roman republic ended - by being turned over to a populist general, Julius Caesar, who had just been declared dictator for life. After his assassination and a short interregnum, it was his grandnephew Octavian who succeeded him and became the first Roman emperor, Augustus Caesar.
The US military is unlikely to go that route?. But one cannot ignore the fact that professional military officers seem to have played a considerable role in getting rid of their civilian overlord, secretary of defense Donald Rumsfeld. The new directors of the CIA, its main internal branches, the National Security Agency, and many other key organs of the "defense establishment" are now military (or ex-military) officers, strongly suggesting that the military does not need to take over the government to control it. Meanwhile, the all-volunteer US Army has emerged as an ever more separate institution in US society, its profile less and less like that of the general populace.
Nonetheless, military coups, however decorous, are not part of the US tradition, nor that of the officer corps, which might well worry about how the citizenry would react to a move toward open military dictatorship. Moreover, prosecutions of low-level military torturers from Abu Ghraib prison and killers of civilians in Iraq have demonstrated to enlisted troops that obedience to illegal orders can result in dire punishment in a situation where those of higher rank go free. No one knows whether ordinary soldiers, even from what is no longer in any normal sense a citizen army, would obey clearly illegal orders to oust an elected government or whether the officer corps would ever have sufficient confidence to issue such orders. In addition, the present system already offers the military high command so much - in funds, prestige, and future employment via the famed "revolving door" of the military-industrial complex - that a perilous transition to anything like direct military rule would make little sense under reasonably normal conditions.
Whatever future developments may prove to be, my best guess is that the US will continue to maintain a facade of constitutional government and drift along until financial bankruptcy overtakes it. Of course, bankruptcy will not mean the literal end of the US any more than it did for Germany in 1923, China in 1948, or Argentina in 2001-02. It might, in fact, open the way for an unexpected restoration of the US system - or for military rule, revolution, or simply some new development we cannot yet imagine.
Certainly, such a bankruptcy would mean a drastic lowering of Americans' standard of living, a further loss of control over international affairs, a sudden need to adjust to the rise of other powers, including China and India, and a further discrediting of the notion that the United States is somehow exceptional compared with other nations. We will have to learn what it means to be a far poorer country - and the attitudes and manners that go with it. As Anatol Lieven, author of America Right or Wrong: An Anatomy of American Nationalism, [1] observes:
US global power, as presently conceived by the overwhelming majority of the US establishment, is unsustainable ... The empire can no longer raise enough taxes or soldiers, it is increasingly indebted, and key vassal states are no longer reliable ... The result is that the empire can no longer pay for enough of the professional troops it needs to fulfill its self-assumed imperial tasks.
Last February, the Bush administration submitted to Congress a US$439 billion defense appropriation budget for fiscal year 2007. As the country enters 2007, the administration is about to present a nearly $100 billion supplementary request to Congress just for the Iraq and Afghan wars. At the same time, the deficit in the country's current account - the imbalance in the trading of goods and services as well as the shortfall in all other cross-border payments from interest income and rents to dividends and profits on direct investments - underwent its fastest ever quarterly deterioration.
For 2005, the current-account deficit was $805 billion, 6.4% of national income. In that year the US trade deficit, the largest component of the current-account deficit, soared to an all-time high of $725.8 billion, the fourth consecutive year that America 's trade debts set records. The trade deficit with China alone rose to $201.6 billion, the highest imbalance ever recorded with any country. Meanwhile, since mid-2000, the US has lost nearly 3 million manufacturing jobs.
To try to cope with these imbalances, last March 16, Congress raised the national debt limit from $8.2 trillion to $8.96 trillion. This was the fourth time since George W Bush took office that it had to be raised. The national debt is the total amount owed by the government and should not be confused with the federal budget deficit, the annual amount by which federal spending exceeds revenue. Had Congress not raised the debt limit, the US government would not have been able to borrow more money and would have had to default on its massive debts.
Among the creditors that finance these unprecedented sums, the two largest are the central banks of China (with $853.7 billion in reserves) and Japan (with $831.58 billion in reserves), both of which are the managers of the huge trade surpluses these countries enjoy with the United States. This helps explain why America's debt burden has not yet triggered what standard economic theory would dictate: a steep decline in the value of the US dollar followed by a severe contraction of the US economy when Americans found we could no longer afford the foreign goods we like so much. So far, both the Chinese and Japanese governments continue to be willing to be paid in dollars to sustain US purchases of their exports.
For the sake of their own domestic employment, both countries lend huge amounts to the US Treasury, but there is no guarantee of how long they will want to, or be able to do so. Marshall Auerback, an international financial strategist, says the US has become a "Blanche Dubois economy" (so named after the leading character in the Tennessee Williams play A Streetcar Named Desire) heavily dependent on "the kindness of strangers". Unfortunately, in America 's case, as in Blanche's, there are ever fewer strangers willing to support our illusions.
So my own hope is that - if the American people do not find a way to choose democracy over empire - at least our imperial venture will end not with a nuclear bang but a financial whimper. From the present vantage point, it certainly seems a daunting challenge for any president (or Congress) from either party even to begin the task of dismantling the military-industrial complex, ending the pall of "national security" secrecy and the "black budgets" that make public oversight of what the government does impossible, and bringing the president's secret army, the CIA, under democratic control. It's evident that Nemesis - in Greek mythology the goddess of vengeance, the punisher of hubris and arrogance - is already a visitor in the United States, simply biding her time before she makes her presence known.

The hand of Israeli Prime Minister Ariel Sharon in the Jan. 24 assassination of Lebanese former Christian militia leader Elie Hobeika is clear. The assassination occurred within hours of a hearing before a Belgian appeals court, which announced a final decision would be made March 6 on whether the war crimes investigation of Sharon, conducted by a Brussels prosecutor, can go forward. Hobeika had just announced his confirmed intention to be a crucial witness against Sharon. However, this assassination was not simply "tampering with a witness." It is a clear message by Sharon and those who stand behind him, that they will not be denied in their plans for a new Middle East war, despite the clash of civilizations it will ignite.
On Jan. 22, two days before the assassination, Sharon and his generals held a closed forum. According to the Israeli daily Ha'aretz on Jan. 24, several potential war senarios were discussed, one of which envisioned "an all-out war, that would begin with an attack by Hezbollah rockets, combined with a wave of Palestinian attacks." Israel would respond in Lebanon and against Syrian air defenses, and would invade the Palestinian Authority to "make order." Such a war would be modelled after the U.S. campaigns in Kosovo and Afghanistan, using massive Israeli air attacks." Envisioning the possibility of "Syrian Scud missile attacks, Israel could respond with heavy bombardment of missiles sites and infrastructure in Syria."
A few hours after this meeting, Israeli military posts along the Israeli-Lebanon border were the target of anti-tank rocket attacks by the Hezbollah. The Israelis immediately responded by deploying F-16 jets to target Hezbollah positions. The incident did not escalate further. The Israelis claimed the attack was unprovoked; yet, the next day, the United States warned Israel not to conduct military flights over Lebanese territory. This warning was in reference to the fact, that despite Israel's withdrawal from Lebanon last July, its F-16 bombers routinely conduct overflights, often creating sonic booms to terrorize Lebanese cities.
Hobeika was killed in Christian East Beirut by a powerful car-bomb. It was the first killing of a Lebanese who fought in the civil war since the announcement of an amnesty over a decade ago. A London-based Lebanese source pointed out, "You have to understand, there has not been a killing like this in over a decade, not even at the lowest level. No one is going to grieve for Hobeika, but—you know, I don't believe in conspiracies, but this time it is clear to me that it was the Israelis." Such assassinations have not occurred for the simple reason that the "law of revenge" would rekindle the bloody civil war which destroyed much of Lebanon throughout the 1970s and 1980s.
The group that claimed responsibility for the assassination was the "Lebanese for a Free and Independent Lebanon," a group not previously heard of. It accused Hobeika of being a Syrian agent and a traitor. Fitting in with Sharon's war plans, the second part of the statement is a direct threat to Syrian President Bashar Assad. It was a warning that he would suffer the same fate as Hobeika if "he set foot in Lebanon before removing all of his troops." Assad is expected to attend a Beirut meeting soon, and he is not expected to remove the 30,000 Syrian troops prior to his arrival.
While no one has heard of this group, one wonders whether it is linked to the so-called "Government of Lebanon in Exile," whose office address is 59 King George Street, in the center of Jerusalem. Its spokesman, Nagi N. Najjar, recently penned an article denouncing the Belgian government for allowing its prosecutors to investigate allegations that Sharon was responsible for war crimes, because of his role in the massacres in the Sabra and Chatila Palestinian refugee camps in Lebanon in 1982. Najjar claims that the camps were simply "training centers for terrorists." The "government" which Najjar represents is, no doubt, made up of remnants of the so-called South Lebanon Army, which was the mercenary force the Israeli Army created, financed, and armed throughout its 20-year occupation of southern Lebanon. It is the one Lebanese group that did not sign on to the official Lebanese amnesty.
This "government" is also supported by the so-called United States Committee for a Free Lebanon, founded by Lebanese-American and Wall Street "venture capitalist" Ziad K. Abdelnour. According to its official website, the committee's "Golden Circle" of those who have lent "invaluable support" to its cause, include the leading war-mongers inside and outside the Bush Administration. This includes Douglas Feith, U.S. Deputy Secretary of Defense for Policy, and Richard Perle, of the ultra-right-wing American Enterprise Institute, a good friend of the leader of the Bush Administration's war faction, Deputy Secretary of Defense Paul Wolfowitz. Among many others are right-wingers Daniel Pipes, Sen. Jesse Helms (R-N.C.), and Iran-Contra player and former National Security Adviser Robert McFarlane. All are self-proclaimed friends of Sharon. Tampering With a Witness ...
On Jan. 23, less then 24 hours before Hobeika's assassination, a Belgian appeals courts heard final arguments by Sharon's attorneys demanding that the investigation of their client be terminated. As the accompanying interview with Michael Verhaeghe, one of the attorneys representing the Palestinian victims in the case, indicates, the hearing did not seem to go well for Sharon.
Following the Hobeika assassination, Verhaege and his colleagues issued a statement, saying, "The elimination of a key protagonist, who had offered to assist with the enquiry, appears as an evident attempt to undermine the case" (see below).
In 1982, Hobeika was the head of intelligence for the Christian Phalangist militia. It was his unit which took part in the Sabra and Chatila massacre. In his checkered career, he went from an Israeli protégé to a politician who served in the Lebanese government in the 1990s. On July 18, 2001, a few weeks after filing the case against Sharon in Belgium, Hobeika, in a press conference, declared his willingness to go to Brussels to testify. "I openly declare that I am very satisfied that the Sabra and Chatila case has been brought to Belgium, perhaps giving me the first opportunity in 19 years to tell the truth and defend myself and my reputation ... and get cleared of this accusation."
As he was making this declaration, a formal request by the attorneys representing the Palestinian plaintiffs was made to the investigative prosecutor, calling for Hobeika to be invited to testify. The only reason he was not called to Belgium last year, was that the investigation was suspended, while the appeals process was being carried out. That process has now ended, with the Jan. 23 hearing...

Rafic Hariri was eyeing a pristine stretch of beach front land properties north of Tripoli , stretching for miles inland and into the hills behind it, and north to AKKAR . These beaches are of an immense value for a developer and Hariri had huge plans for the area,after he finds a permanent solution to settle the Palestinian refugees elsewhere. He had specific plans for that too, but did not want any Syrian meddling into these monumental projects, and local SUNNI traditional Leaderships did not like very much Hariri having an eye on these areas, especially that if he were to develop such properties, immense benefits for the area would ensue, with thousands of jobs at stake and economic development for an area desperate for investment and jobs. Had he succeeded in getting these projects off the ground, Rafic Hariri would have threatened the local traditional Sunni leaders of Tripoli, and his hegemonistic leadership on the Sunnis in Lebanon would have been almost complete.... but Rafic refused to play ball with the Americans and he wanted to develop that particular airport himself and turn it into a major international tourist hub, after building huge projects in the area . In order to protect his new "turf" and his potential Mega-investments in the North Lebanon, he resorted to a dangerous tactic, traditional to his Saudi Mentors.... Extreme Sunni local tribes, "turned Jihadists" in order to scare overseas investors and Imperial Hubris from poking in his projected new investment territories, and keep everyone away from the "prize"....the end result is what we see today in the North Of Lebanon, in Nahr Al-Bared and in all of the areas stretching from Jubeil, all the way to Kleiat and Akkar....[ watch and learn from the New Hollywoodian long Film, Unfold in front of your very eyes...]
When this approach with Hariri failed, the US turned to another local Sunni with strong ties to the Syrians...What I can tell you is that 4 years ago, a Lebanese middleman approached then Transport Minister Najib Mikati and told him the US is very keen on Koley'at. Mikati went to see his Syrian mentors (Makhloufs) and tried to woo them by promising riches ensuing from modernization work on the airport and basing rights for the US Air Force and NATO etc. At first the Syrians were willing to play, then US-Syrian relations soured.... for a while..... a tug of war is sure to unfold here, and the winners will have a big prize.

One can see the wisdom in his very visage. The hazel eyes, glowing from sockets lined with deep suntan emotions, beam with the brilliance of a limelight. His hair, looking like spun silver, sits neatly in place upon his head. Yet, as he nods slightly, it sparkles, each strand in concert, as if to echo the exuberance of his own nature.His nose, strong and stately, arcs proudly above the overshadowed yet undaunted mouth. The lips, bold as they are, show incredible kindness and generosity, especially when he curls them into one of his particularly boyish grins. His countenance mirrors his being and in that beautiful angel face one can see a child playing in a meadow.His forty six years do not show themselves in his posture. He stands tall, erect; and moves with unmitigated grace. Always dressed in perfect clothes, his bright colors dazzle and shine in the Lebanon sun. What a sight this man is to behold! The experiences, heartbreaks, loves, joys, and victories of forty six years of living, all combine into one fascinating embodiment within him, a Heroes' Hero and the greatest man ever.

In life you can't get all you want, so you better have your priorities right....In Lebanon , the people were on the streets demanding change from day one after the war ended. In Israel, change will come from the security establishment, but even after Olmert, Katsav and Amir Peretz resign after this, politics will be as usual,No Leadership in sight. They will say "ok ok", we have made mistakes, but nothing that hasn't been done before, by Meir, Sharon, Mofaz, Dayan and so we will learn and Israel must stand in the face of Palestinian Terror, GOD "save" G.W.Bush, from a similar "commission" in USA, Baker Hamilton was a soft landing so far, for the Killer Murderers in DOD, CIA etc. , and death to the "Axis of Evil", Iran. They will then kill some more Pals, shoot some more missiles, have a meeting with Bush and throw more money at ISRAEL. Israel will then forget about the 2 soldiers in Lebanon, after Shalit is brought home, as they did with Arad. The Israeli govt. failed Arad. Moshe Katsav, Ehud Olmert and Amir Peretz can look forward to a healthy retirement somewhere in Herzliya after they get fed up with corruption and killings. Whereas the politicians in Lebanon are counting their lucky stars for everyday they wake up! That's how it should be for scummy politicians. USA today.... It`s sad how Israel`s elections are looking more like American elections -- heavy on TV sound bites and light on important issues....and No Leadership....just like Lebanon today. Lebanon today.??? Anyone we elect should be a firm supporter of our Resistance, and assemble a strong team to handle Israeli and Syrian terrorism with unwavering resolve and guided by the national Interest. Hariri and Sanyoura did not, and look what we got.? The whole govt. should resign and call new elections, but the lingering Feudal style political culture in the Lebanese governmental system, means these blow hoards will stay on as long as possible. Even the President who has been, is an accomplice in Murders, hasn't resigned, this is egotism at its most revolting...NOW, we have a new Lebanese President, a wimp, weak, "faiblard"... and who is accessory to murders/assassinjations in Lebanon also, having been LAF commander in chief, since military intelligence and one military garrisson...are directly involoved in carrying out the White House Murder Inc's assassinations in Lebanon, just like in Syria's situattion....with Imad F. Moughnieh and other murders in Syria... Lebanon needs to do a lot of work on itself and this can only really begin once it dumped the failed "ME", ME, ME syndrom.... Israel's priority is to nuke Iran out of its possibility of developing nuclear bombs. Everything else is 100 times less important. if Iran develops nukes, 9 million Israelis and Lebanese will die... It's just a matter of time... 100 times less than 9 millions is 90 thousand. So if Israel does something that ends with 90 thousand Israelis/Lebs dead, it is a GREAT strategic goal...?, IF Iran is definitely wiped off as a nuclear power. If Hezbollah would be rapidly wiped off, the possibility of US fighting against Iran diminishes. And we DON't want that to happen... We prefer to let Hezbollah live and have the US realize the inevitability of having a new startegic alliance with Iran...soonest, out of nuclear capability. No one normal LIKES wars (between other things it would push the barrel of oil to 600 dollars) but, again, you cant have everything you desire in life... Israelis and Jews know that, they were..., used to be... good at thinking?...not anymore it seems ; Americans still have too much wishful thinking....?
